Reference: FCC Rules Sections 0.457(d) and 0.459 as authority for confidentiality request FCC ID#: 2ACTZMSS90 Reference #:46704 731 Form #: EA604696 ACSS FRN: 0004999231 Dear Ms. Cherry: In accordance with FCC Rules Sections 0.457(d) and 0.459 as the authority, ACSS submitted a request that long—term confidentiality be granted for a number of schematic drawings under our FCC application for FCC ID# 2ACTZMSS90. If I am understanding the request in your correspondence correctly you are asking for a Non—Disclosure agreement between the grantee and the purchaser. In this case, for the grantee and the purchaser, l am assuming that you are referring to the Non—Disclosure agreement. As such, | would believe that the purchaser would be ACSS and that the grantee would be L3 Communications Avionics Systems; basically ACSS purchaser the drawings and Avionics Systems selling them to us. In actuality, both ACSS and Avionics Systems are divisions of L3 Communications and the NGT—9000 is a sort of joint venture between the two divisions. For the actual FCC Grant Certificate application, ACSS would in fact be the grantee, according to the way the 731 application is set up. As your correspondence does not identify who the grantee (ACSS or AS) and purchaser (again ACSS or AS) are that you are seeking a copy of the Non—Disclosure from, we are seeking this information to try and avoid any confusion in the documentation that may be provided. As we (ACSS and AS) are actually two divisions of one company, I am not sure what (if any) Non—Disclosures may be available.

Subject: Confidentiality request for schematics drawings submitted in support of FCC Certification for ACSS Multilink Transponder part number 9029000—20000 (Model NGT—9000). Any help you can provide on the definition of who the grantee and the purchaser are for the copy of the Non—Disclosure agreement that is required would be greatly appreciated. 1 did look through the FCC documents that you provided, but was unable to come up with a good answer for this from them.
