Dear Mr Richard Prasad,

This refers to application, File No. 0281-EX-ST-2018, for an experimental authorization.

You are advised that the Commission is unable to grant your application for the facilities requested. The
application is dismissed without prejudice to refiling. International Bureau objected to authorize this
experimental license. If Tyvak does choose to refile, it should include an analysis showing how it will
protect existing services in the bands being requested. In particular, as part of its refiled application,
Tyvak must provide the written consent of Sirius XM Radio for any proposed use of the 2320-2345 MHz
band, which is primarily allocated for use by SDARS (satellite radio). To request this written consent,
applicant should contact James S. Blitz, Vice President, Regulatory Counsel, Sirius XM Radio, (202)

Any re-filed application should also address why the proposed operations are appropriate for licensing as
non-federal assignments, given that the satellite operates under Federal control pursuant to a Federal
assignment for TT&C frequencies.
