You are advised that the Commission is unable to grant your application for the facilities requested. The application is dismissed without prejudice to refiling. International Bureau objected to authorize this experimental license. If Tyvak does choose to refile, it should include an analysis showing how it will protect existing services in the bands being requested. In particular, as part of its refiled application, Tyvak must provide the written consent of Sirius XM Radio for any proposed use of the 2320-2345 MHz band, which is primarily allocated for use by SDARS (satellite radio).
