(collectively "NextWave") has no objection to the associated application of Sprint Communications Company, L.P., a wholly owned indirect subsidiary of Sprint Nextel Corporation (collectively "Sprint") for an Experimental Authorization to transmit on the WCS A Block frequencies 2305—2310/2350—2355 MHz ("Spectrum") at its campus in Overland Park, Kansas"), per the terms and conditions of the Memorandum of Understanding ("MoU") entered into by NextWave and Sprint.‘ NextWave is the licensee of KNLB306 WCS Channel Block—A (2305—2310/2350—2355 MHz) in MEAO2Y — Kansas City. Sprint‘s campus in Overland Park, Kansas is included within KNLB306‘s geographic coverage area. NextWave currently has no operationsin the vicinity of Sprint‘s Overland Park campus. In cooperation with a number of vendors, Sprint proposes to conduct tests of new and innovative backhaul solutions using WCS spectrum. Sprint states that all testing will be conducted wholly within Sprint‘s Overland Park campus. These tests will be used to evaluate backhaul solutions to support Sprint‘s Network Vision and related broadband deployment initiatives, Sprint anticipates that the period ofthese tests will not exceed one year. Further, in the highly unlikely event that any harmful interference occurs, Sprint agrees to cease operation on KNLB306‘s WCS frequencies immediately upon receiving notification. Accordingly, NextWave has no objection to the Commission‘s grant of Sprint‘s application for an Experimental Authorization to operate on KNLB306‘s Block—A WCS frequencies for a period of one year at Sprint‘s Overland Park, Kansas campus. y Jen'gif t M. NextWave may require by written notice, at any time and for any reason, that Sprint immediately suspend any over the air use of the Spectrum, NextWave will try to give Sprint as much advance notification as possible priorto requiring termination of access to the Spectrum.
