                     APPLICATION FOR LICENSE MODIFICATION

Panasonic seeks to modify its experimental license for Ku-band AMSS operations to include
reference to compliance with Recommendation ITU-R M.1643 (the baseline ITU document
governing Ku-band AMSS operations) and other regulatory requirements. This is needed to
support EASA certification of the Panasonic phased array aircraft earth station (AES) terminal
(previously called the Aura LE).

Panasonic does not seek to alter its substantive authority but rather seeks confirmation of what is
already understood to be a substantive condition of its authority: the terminals must comply with
the ITU rules and other applicable regulatory requirements. Panasonic has proposed language
for two additional conditions to its license: one addressing ITU and international regulations, and
one addressing compliance with the AMSS rules that are expected to be released by the
International Bureau.

Proposed conditions:

(5) The aircraft earth station equipment authorized herein (i.e., Panasonic Avionics Corporation’s
Aura LE phased array terminal and MELCO terminal) shall be compliant and shall operate in
compliance with Recommendation ITU-R M.1643. The aircraft earth station equipment
authorized herein shall also operate in compliance with other international regulatory
requirements that may be applicable to such equipment or operations.

(6) This authorization and all conditions contained herein are subject to the final outcome of the
Commission’s rulemaking in IB Docket No. 05-20 and the aircraft earth station equipment shall
operate in compliance with any pertinent rule requirements subsequently adopted by the
Commission.
