Dear Mr. Young,

We have received your message from May 24, 2007 and reviewed the waiver FCC granted to
Multispectral Solutions, Inc. (MSSI) .

We do NOT believe that the waiver FCC has installed eliminates our need for an experimental license.
Please read the following reasons for our justification:

- The research we intend to conduct with MSSI?s Ultra-Wideband equipment and tags is of immediate
importance. It will have significant impact on safety related to heavy construction equipment operation
and workforce interaction.

- The waiver FCC has issued has not the impact on our research, since MSSI Inc. has currently no
commercially product available at this moment that provides the required automated tag shut-off function
as stated in the FCC waiver (according to MSSI a commercial product with automatic shut-off function
needs further development of up to one year).

- In our experiments we will able to control the use of the existing 1-W tags in the construction
environment by handing out and collecting the tags on a daily basis. Construction sites generally have a
few gated access areas that will make this procedure an easy task.

- As stated in our request for experimental license, our experiments will require only a small number of
1-W powered tags to demonstrate the feasibility of our research approach. The small nature of our
experiment is well defined and fully controllable.

- A temporary experimental license will allow us to proceed in our experiments before MSSI is able to
deliver the 1-W tags that have automatic shut-off capability.

Subsequently, please keep our request for experimental license ACTIVE. We would appreciate if FCC
can provide us with an experimental license as soon as possible.


Our research intends to actively prevent accidents and fatalities in the construction industry and based on
the statistics for the past eleven years 3 construction workers die every day in the United States alone.
Many of these accidents have heavy equipment involved.
Thank you very much for your understanding and actions in this matter. I am more than happy to assist in

The FCC recently granted a waiver
(http://hraunfoss.fcc.gov/edocs_public/attachmatch/FCC-07-95A1.pdf) to Multispectral Solutions, Inc.
(MSSI) to allow use of the same RFID tags that you have requested to use in this application. We believe
this eliminates your need for an experimental license. Respond to this email by requesting withdrawal of
the application or submit a justification for your need for license.
