Answers to questions presented:

Question 1: No, we do not intend to eventually comply with the Part 15 output power limits.
The long term purpose of the study is to perform research and to collect data for the purposes of
studying mobile MIMO channel characteristics. The request for permission to use ERP levels
up to 5.1 watts is driven by the need to increase the dynamic range of these measurements. We
do not intend to operate our data collection system indefinitely, but do anticipate that this study
will be on-going over the next three years, until November, 2009. What we are requesting is to
get temporary permission to operate at this higher ERP level for research purposes only.

Also note that the testing we are performing is mobile-to-mobile. The allowed transmit power
levels that are specified in Section 15.247 for systems with antenna gains greater than 6 dBi
assumes fixed point-to-point operation. The requirements for antennas having gains greater
than 6 dBi allows antenna types 3 and 6 in our application to meet the FCC requirements, but
we are unsure if the requirements differ for mobile-to-mobile operation. We request that the
FCC give us some clarification on this point.

Question 2:– Yes we are seeking to operate over the entire 2405 – 2478 MHz band, and the
other smaller bands can be deleted from the application.
