FCC Rules Part 0.459(b) Responses

1.        Identification of the specific information for which confidential treatment is sought

All information shown within this presentation package is requested to receive confidential treatment.

2.      Identification of the Commission proceeding in which the information was submitted or a
description of the circumstances giving rise to the submission

The U.S. Army customer (PM-Cruise Missile Defense Systems) requested General Dynamics Land
Systems (GDLS) to obtain an FCC license providing authorization to energize the “Multi-Mission
Hemispheric Radar (MHR) On-Board Radar x4 (Detect/Track)” product at the GDLS facility in
Sterling Heights, MI. The purpose is to fully test the MHR product during vehicle acceptance testing,
discover production deficiencies, and apply corrective actions with assigned company partners prior to
shipment to Government test sites (RTC, WSMR, APG).

3.      Explanation of the degree to which the information is commercial or financial, or contains a trade
secret or is privileged

All information is designated for military purposes only (not commercial), contains no financials, contains
no trade secrets, and is privileged to team members assigned to perform activities on the program.

4.     Explanation of the degree to which the information concerns a service that is subject to
competition

The 3 contracts awarded to 3 separate companies may be subject to re-competition if any original
awardee is unable to perform the requirements of their respective contacts in terms of cost, schedule,
and performance.

5.        Explanation of how disclosure of the information could result in substantial competitive harm

Disclosing this information could result in substantial competitive harm by revealing to the world what the
United States is planning for regarding IM-SHORAD that is more detailed than what the media has
already communicated over newspapers, TV, and the Internet.

6.        Identification of any measures taken by the submitting party to prevent unauthorized disclosure

All information is stored on secure and encrypted GDLS computer servers requiring authorized employee
identification badges with electronic chip technology along with administrator access granted to properly
access this information using company-issued computers.

7.      Identification of whether the information is available to the public and the extent of any previous
disclosure of the information to third parties

None of this information is currently available to the public and no previous disclosures have occurred to


third parties by GDLS.

8.      Justification of the period during which the submitting party asserts that material should not be
available for public disclosure

The time period of 12 months from time of license granted will allow for all vehicle acceptance testing to
be completed and absorb any unforeseen delays from company partners with on-time completion and
resolution of all issues to the customer’s satisfaction.

9.     Any other information that the party seeking confidential treatment believes may be useful in
assessing whether its request for confidentiality should be granted.

Due to the U.S. Army categorizing this program as a “rapid prototyping program” setup as
an Urgent Material Release (UMR) for the soldiers receiving this new short range air defense capability,
the confidential sensitivity with the content of this presentation package is paramount. There is currently
more than enough other public information available about this IM-SHORAD program to satisfy the needs
of the general United States public to give them confidence and overall program support. More detailed
information may allow other competitor countries to be aware of our plans and potentially initiate counter
military efforts that are unanticipated.
