The frequency 4990 MHz has a 12 MHz bandwidth. This means that 6 MHz of the signal would spill into
the 4990-5000 MHz radio astronomy band, which is not permitted. You must move the frequency at least
6 MHz lower to avoid transmitting in the prohibited radio astronomy band. If your two 4 GHz frequencies
must be exactly 50 MHz apart, this means that you must lower the 4940 MHz request by at least 6 MHz
also. Regardless, the 12 MHz bandwidth requested for 4940 MHz already spills into the government
4800-4940 MHz band and would need to be coordinated with NTIA. Advise on how you would like to
proceed.

The items indicated above must be submitted before processing can continue on the above referenced
application. Failure to provide the requested information within 30 days of October 22, 2009 may result in
application dismissal pursuant to Section 5.67 and forfeiture of the filing fee pursuant to Section 1.1108.
