Dear Mr Young,

This experiment was intended for non-US frequencies only. Filing 0555-EX-PL-2007 is for 3650-3700
MHz US frequencies only. I used 0555 as a template for the rreferenced filing (0593-EX-PL-2007), and
tried to delete 4.9 GHz frequencies and change the others to 3400-3650 MHz non-US only.

The client is US based, has sales internationally, and is fully aware of the restrictions in the 3400-3650
MHz bands, which are not allocated for commercial use the way they are in Europe and elsewhere. The
equipment used is identical and the location of the experiment is the same, just the operating frequencies
are different. Two licenses were filed because the applicant is aware of the additional administrative and
regulatory burden of performing an experiment in the non-US bands.

I downloaded the filing instructions and tried to follow them when deleting frequencies and changing
others, but it seems the old frequency bands remain on the application. Please let me know if I am
missing some instructions or whatever else I need to do so that the application you ask about has only
the non-US frequencies.

The client is fully aware that equipment in the non-US bands must only be sold for use overseas, and he
will be marketing the products in compliance with these requriement.s The experiment is for the
purposes of testing and demonstrating over the air network performance in an actual field situation.

1. What is the relationship between this application and file no. 0555-EX-PL-2007? This application
appears to encompass all frequencies included in 0555-EX-PL-2007 at the same location.
2. Applicant must know that approval of 3400-3650 MHz may be difficult because of government radars in
the band. NTIA also may be hesitant to approve WiMAX in the government band for fear of an attempted
spectrum grab. Applicant has stated that the equipment being used is not for sale or use within the
United States, yet states that one of the objectives of the experiment is for demo to potential customers.
Are these customers foreign, or if they are domestic, will they be informed that under no circumstances
can the equipment be used in the United States?
