                          REQUEST FOR EXPEDITED PROCESSING

        Pursuant to Section 5.61(a) of the Commission’s rules, DIRECTV Enterprises,

LLC (“DIRECTV”) hereby requests that its application for special temporary authority

(“STA”) to launch and operate an experimental satellite payload in the 17/24 GHz BSS

band be given expedited processing.

        The Commission has authorized DIRECTV to launch and operate DIRECTV 11,

a Ka-band satellite to be located at 99.2° W.L. which is a critical component in

DIRECTV’s continued expansion of national and local high definition (“HD”) television

programming for American consumers. The satellite is fully constructed and will soon

ship to the launch site to be mated with a Sea Launch vehicle for a scheduled launch in

mid-January 2008.

        DIRECTV also has added to the satellite an experimental 17/24 GHz BSS

payload, which stands to be the first such payload launched into space. Although the

Commission recently adopted processing and service rules for this band, it also issued a

further notice of proposed rulemaking (“FNPRM”) requesting further information on a

number of technical and spectrum sharing issues.1 However, because there are no

satellites or earth stations operating in this band, there is no operational data available to

the Commission for consideration in resolving these issues. DIRECTV intends to use its

experimental operations to, among other things, provide the Commission with empirical

data upon which to base its decisions in the FNPRM proceeding.

       DIRECTV cannot afford to delay the launch of this critical satellite – and thereby

delay the next phase in its HD expansion – while awaiting launch authority for the

experimental payload. In addition, delay would deny the Commission much-needed data

that will provide it a sounder footing upon which to resolve the technical and spectrum

sharing issues raised in the pending FNPRM. For these reasons, DIRECTV requests that

its STA application be granted expedited processing.
