From: Peter Blouke To: Leann Nguyen Date: April 22, 2009 Subject: FCC File 0398-EX-PL-2008 ---------------------------------------------------------------------------------------------------------------- Message: This correspondence is submitted on behalf of Bigelow Aerospace, LLC (Bigelow Aerospace) as a final response to OET?s October 17, 2008 request for additional information. At that time, the applicant was requested to provide an analysis of the ability of its transmitting stations to avoid interference to satellite networks operating in the geostationary orbit (?GSO?). Due to the complexities involved in producing such a study consistent with the requirements of Sections 25.146 and 25.208 of the Commission?s Rules, Bigelow Aerospace requested extensions of time to prepare and submit a complete response to and including today, April 22, 2009. That interference study is now complete, and while it shows that Bigelow Aerospace could successfully share the Ku-band spectrum with operational GSO networks, the current cost of the ground-station equipment required to achieve such successful sharing exceeds the budgetary allowance for this element of Bigelow Aerospace?s current experimental program. Accordingly, Bigelow Aerospace wishes to withdraw the pending application, File No. 0398-EX-PL-2008. Bigelow Aerospace appreciates the understanding of OET staff in permitting it additional time to complete its interference study while the current application has remained pending. In the event that circumstances change in a manner that would facilitate Ku-band NGSO operation by Bigelow Aerospace, it will submit a new application for Ku-band experimental authority.
