The applications listed below have been found, upon initial review, to be acceptable for filing. The Commission
reserves the right to return any of the applications if, upon further examination, it is determined the application is not in
conformance with the Commission's rules or its policies. Consideration of each satellite application in this Public
Notice may depend on the Commission's action on another satellite application earlier in the queue. Petitions,
oppositions and other pleadings filed in response to this notice should conform to Section 25.154 of the Commission's

Letter of Intent


On November 10, 2009, Hughes Network Systems, LLC, filed a Letter of Intent (LOI) seeking access to the market in the United States using its
SPACEWAY 4 GSO Ka-band space station licensed by the Administration of the United Kingdom at the 107.1° W.L. orbital location. In its
market access request, Hughes seeks to operate the SPACEWAY 4 space station in the following frequency bands: 28.35-29.1 GHz and
29.25-30.0 GHz (Earth-to-space); 18.3-19.3 GHz and 19.7-20.2 GHz (space-to-Earth) with operations in the 18.8-19.3 GHz bands on a
non-harmful interference basis. Hughes requests waivers, to the extent necessary, of Section 25.114(c)(4)(iii) and Section 2.106 Footnote,
NG165 to the United States Table of Frequency Allocations.

This application reflects changes to the design of the SPACEWAY 4 space station for which a market access request was previously submitted by
Hughes in 2008. See SAT-LOI-20080603-00118; SAT-AMD-20090608-00065 (Call Sign S2753). The November 10, 2009 LOI seeks to use the
same orbital location and frequencies that were requested in 2008, with the exception that Hughes no longer seeks to use the 28.1-28.35 GHz
frequency band (Earth-to-space). Pursuant to 25.137(e) of the Commission's rules, the November 10, 2009 application will be treated as an
amendment to the previously filed market access request for the SPACEWAY 4 space station for purposes of processing under the Commission's
first-come, first-served licensing queue. As a result, we will retain the same call sign (Call Sign S2753) for the SPACEWAY 4 space station. To
avoid confusion regarding the technical characteristics of the market access request for the SPACEWAY 4 space station, however, we will close
the prior files (SAT-LOI-20080603-00118; SAT-AMD-20090608-00065 ) in our licensing database.

ViaSat, Inc. requests authority to modify the authorization for its Ka-band satellite, VIASAT-77, at the 77.3º W.L. orbital location to add use of
the 18.8-19.3 GHz band (space-to-Earth) on a non-interference basis, and the 28.6-29.1 GHz band (Earth-to-space) on a secondary basis. ViaSat
seeks waivers of Sections 2.106, NG165, and 25.210(i) of the Commission's rules.

Special Temporary Authority


Intelsat North America, LLC seeks special temporary authority for a period of 60 days, beginning February 15, 2010, to drift its C-/Ku-band space
station Intelsat 801 from 31.5º W.L. to 29.5º W.L. and to operate it temporarily at the 29.5º W.L. location. Intelsat proposes to operate in the
3625-4200 MHz band (Earth-to-space) and 5850-6425 MHz band (space-to-Earth) during the drift and to operate in these bands, as well as the
14.0-14.5 GHz (Earth-to-space) and 10.95-11.2 GHz, 11.45-11.95 GHz and 12.5-12.75 GHz (space-to-Earth), once the space station has arrived at
the 29.5º W.L. location. Intelsat states that the 12.5-12.75 GHz band will be used only in ITU Region 1.
