Petition for Declaratory Ruling to be Added to the Permitted List

Nature of Service:       Fixed Satellite Service


On October 15, 2009, the Satellite Division granted the Petition for Declaratory Ruling filed by HISPAMAR SATÉLITES, S.A. to add the
AMAZONAS-2 space station, licensed by Brazil and located at the 61º W.L. orbital location, to the Commission's Permitted Space Station List.
Accordingly, each U.S.-licensed earth station with "ALSAT" designated as a point of communication is granted authority to provide
Fixed-Satellite Service (FSS) in the 14.0-14.5 GHz (Earth-to-space) and 11.7-12.2 GHz (space-to-Earth) frequency bands to, from or within the
United States, by accessing AMAZONAS-2 at the 61º W.L. orbital location, in accordance with the technical specifications set forth in
HISPAMAR's petition, subject to conditions.

SAT-MOD-20070730-00107                 S2129           DG Consents Sub, Inc.
The Bureau has determined that DG Consents Sub, Inc., a wholly-owned subsidiary of DigitalGlobe, Inc., has met the fifth and last
milestone associated with this authorization, the Bring All the Satellites in the Licensed System Into Operation milestone, pursuant to
Section 25.164(b)(5) of the Commission’s rules, 47 C.F.R. § 25.164(b)(5). The Bureau previously determined that DG Consents Sub, Inc.
had met the Contract Execution, Critical Design Review, Commence Construction, and Launch the First Satellite in the System milestones
for this authorization, thereby reducing the $5 million bond amount by 80% to $1 million. See Public Notice Report No. SAT-00484, DA
No. 07-4711, rel. November 23, 2007. Consequently, DG Consents Sub, Inc. may reduce the bond amount by the final 20% or $1 million as
provided in the Amendment of the Commission's Space Station Licensing Rules and Policies, First Report and Order and Further Notice of
Proposed Rulemaking, IB Docket No. 02-34, 18 FCC Rcd 10760 (2003); Amendment of the Commission's Space Station Licensing Rules
and Policies, First Order on Reconsideration and Fifth Report and Order, IB Docket No. 02-34, 19 FCC Rcd 12637 (2004). Thus, DG
Consents Sub, Inc. has satisfied all of its milestone requirements and accordingly may remove the bond for this authorization.



SAT-MOD-20090429-00046                 S2358           SkyTerra Subsidiary LLC
On October 15, 2009, the Satellite Division granted the motion of SkyTerra Subsidiary LLC to designate the following applications to
modify SkyTerra's authority to operate its current and future mobile satellite service systems using certain frequencies in the L-band as
"permit-but-disclose" for purposes of the Commission's rules governing ex parte communications, effective October 15, 2009: IBFS File
Nos. SAT-MOD-20090429-00046, SAT-MOD-20090429-00047, and SES-MOD-20090429-00536. See 47 C.F.R. §§ 1.1200(a), 1.1206
and 1.1208 note 2. We find that designating these proceedings as "permit-but-disclose" will facilitate resolution of the complex policy
issues raised by the applications. This action is without prejudice to any determination regarding the processing of these applications.
