The Commission reserves the right to return any of the applications if, upon further examination, it is determined the application is not in conformance with the Commission's rules or its policies. Consideration of each satellite application in this Public Notice may depend on the Commission's action on another satellite application earlier in the queue. Petitions, oppositions and other pleadings filed in response to this notice should conform to Section 25.154 of the Commission's rules, unless otherwise noted. 47 C.F.R. § 25.154. SAT-LOA-20090528-00060 E S2791 EchoStar Corporation Date Filed: 05/28/2009 15:39:59:46000 Launch and Operating Authority EchoStar Corporation (EchoStar) has filed an application for authority to launch and operate a geostationary orbit satellite (GSO) satellite in the Fixed-Satellite Service using the C-band frequencies 3700-4200 MHz (space-to-Earth) and 5925-6425 MHz (Earth-to-space) at the 84.9° W.L. orbital location. EchoStar proposes to operate its telemetry, tracking and commend (TT&C) operations at the edges of the 6/4 GHz frequency bands. EchoStar states that to the extent that information relating to specific TT&C frequencies and satellite spacecraft design is not known because it has not selected a satellite manufacturer, EchoStar requests a limited waiver of the rules, to the extent one is necessary, to submit its application without the requested information. EchoStar also states that the presumption raised in Section 25.159(d) of the Commission’s rules should not apply to this application. To the extent the Commission determines that Section 25.159(d) applies to its application, EchoStar seeks a waiver of this rule. Date Filed: 08/06/2009 16:56:40:73600 Petition for Declaratory Ruling to be Added to the Permitted List Hispamar Satélites, S.A. (Hispamar) has filed a petition for declaratory ruling seeking to access the U.S. market by adding the Amazonas-2 Ku-band geostationary satellite orbit (GSO) Fixed-Satellite Service (FSS) space station to the Commission’s Permitted Space Station List. The Amazonas-2 space station is to be located at the 61º W.L. orbital location and is licensed under the laws of Brazil. Hispamar seeks to access the U.S. market using the 14.0-14.5 GHz (Earth-to-space) and 11.7-12.2 GHz (space-to-Earth) frequency bands.
