reserves the right to return any of the applications if, upon further examination, it is determined the application is not in
conformance with the Commission's rules or its policies. Consideration of each satellite application in this Public
Notice may depend on the Commission's action on another satellite application earlier in the queue. Petitions,
oppositions and other pleadings filed in response to this notice should conform to Section 25.154 of the Commission's

Letter of Intent


Spectrum Five LLC (Spectrum Five) filed a petition for declaratory ruling seeking to access the market in the United States through a
Netherlands-authorized 17/24 GHz Broadcasting-Satellite Service (BSS) space station at the 118.8° W.L. orbital location, which is offset 0.2°
from the 119° W.L. orbital location specified in Appendix F to the 17/24 GHz Report and Order, FCC No. 07-76 (rel. May 4, 2007), at reduced
power and without full interference protection. (See FCC 07-76 and 07-174 for a complete explanation of the rules and policies regarding the
spacing framework and interference protections adopted by the Commission). Spectrum Five seeks to use the 17.3-17.7 GHz (space-to-Earth) and
the 24.75-25.25 GHz (Earth-to-space) frequency bands. Spectrum Five seeks to perform telemetry, tracking, and command operations at the
edges of the 17.3-17.7 GHz (space-to-Earth) and the 24.75-25.25 GHz (Earth-to-space) frequency bands. Spectrum Five requests a partial waiver
of 47 C.F.R. § 25.114(c) to provide a representative service area for the network’s numerous beams rather than every service area in response to
Section S6 of the Schedule S.

PanAmSat Licensee Corp. seeks to modify its license for the Intelsat 2 satellite by extending the license term. Although originally requesting a
five-year extension through August 1, 2014, PanAmSat has amended its application to reduce the requested extension period to 28 months, until
December 1, 2011. See SAT-AMD-20090526-00057. PanAmSat is not proposing any change in Intelsat 2’s operations, which will continue to
conform to the technical parameters on file with the Commission.

the United States using L-band spectrum coordinated for MSS operation via the MSV-1 satellite (Call Sign S2358). SkyTerra proposes technical
changes to reflect a multilateral coordination agreement with SkyTerra (Canada) Inc. and Inmarsat Global Limited and requests waiver of the
following provisions of the Commission's rules: Section 25.253(b) (base station out-of-channel emission limit), Section 25.253(d)(1)-(4) (base
station EIRP limits), Section 25.253(d)(5) (limits on base station PFD near airport runways and stand areas), Section 25.253(d)(6)-(7) (limits on
base station PFD at the edges of navigable waterways), Section 25.253(d)(8) (limit on base station antenna gain), Section 25.253(e) (base station
polarization and overhead gain suppression), Section 25.253(f)(1) (requirement pertaining to coordination with SARSAT operations), and Section
25.253(g)(1) (limits on mobile-terminal EIRP and out-of-channel emissions). SkyTerra also requests authority to operate with any air interface
protocol, provided such operations are consistent with agreed parameters in the multilateral coordination agreement.
