The Commission reserves the right to return any of the applications if, upon further examination, it is determined the application is not in conformance with the Commission's rules or its policies. Consideration of each satellite application in this Public Notice may depend on the Commission's action on another satellite application earlier in the queue. Date Filed: 02/17/2009 16:31:29:37600 Launch and Operating Authority On February 17, 2009, XM Radio Inc. filed a request for authority to launch and operate a new Satellite Digital Audio Radio Service (SDARS) space station, designated as XM-5, at the 85.2° W.L. orbital location for use as an in-orbit spare for both the Sirius Radio Inc. (2320-2332.5 MHz) and XM Radio Inc. (2332.5-2345 MHz) SDARS systems. The XM-5 satellite will receive feeder link transmissions in the 7050.5-7072.5 MHz band.
