On September 17, 2008, the Satellite Policy Branch granted with conditions, the application of Satellite CD Radio Inc. (Satellite CD Radio) to
modify its existing Satellite Digital Audio Radio Service (SDARS) non-geostationary satellite orbit (NGSO) constellation (Call Sign S2105) by
constructing, launching, and operating an NGSO satellite, FM-6. FM-6 will replace Satellite CD Radio's existing satellites, FM-1 and FM-2, after
expiration of their useful lifetimes. The FM-6 satellite will operate with an orbital plane that is halfway between the orbits of FM-1 and FM-2 and
will be located 180 degrees opposite Satellite CD Radio's other existing satellite, FM-3, using the frequency bands 2320-2332.5 MHz
(space-to-Earth) and 7050.5-7072.5 MHz (Earth-to-space).

perform telemetry, tracking, and command operations during the relocation of the EchoStar 8 satellite from the 110° W.L. orbital location to the
77° W.L orbital location.

The FCC has taken the administrative action of listing this request as granted. The request sought continuation of operations of the EchoStar 8

satellite was operated during the requested period pursuant to Section 1.62 of the Commission's rules, subject to the conditions specified in the
prior authorization.

The Bureau has determined that ViaSat, Inc. has met the contract execution milestone associated with this authorization (File No.
SAT-LOA-20070314-00051), and may reduce the bond amount by 25% as provided in the Amendment of the Commission's Space Station
Licensing Rules and Policies, First Report and Order and Further Notice of Proposed Rulemaking. IB Docket No. 02-34, 18 FCC Rcd
10760 (2003); Amendment of the Commission's Space Station Licensing Rules and Policies, First Order on Reconsideration and Fifth
Report and Order, IB Docket No. 02-34, 19 FCC Rcd 12637 (2004). We note that the satellite is to be constructed with the capability of
operating in the 18.8-19.3 GHz (downlink) and 28.6-29.1 GHz (uplink) bands. (See File No. SAT-MOD-20080718-00144). ViaSat may not
operate in these bands without authority from the Commission.
