the right to return any of the applications if, upon further examination, it is determined the application is not in
conformance with the Commission's rules or its policies. Consideration of each satellite application in this Public Notice
may depend on the Commission's action on another satellite application earlier in the queue. Petitions, oppositions and
other pleadings filed in response to this notice should conform to Section 25.154 of the Commission's rules, unless

Intelsat North America LLC (Intelsat) has filed an application for the modification of its license for the INTELSAT 709 satellite,
currently operating in the C- and Ku-frequency bands at the 85.15 E.L. orbit location. Intelsat requests authority to operate the
INTELSAT 709 satellite in the 11.7-11.95 GHz frequency band. Specifically, Intelsat seeks authority to allow a non-conforming use
of the 11.7-11.95 GHz frequency band in International Telecommunication Union (ITU) Regions 1 and 3 to provide fixed-satellite
service on a non-harmful interference basis, in order to support U.S. Government operations in the Middle East.

Intelsat requests that the Commission waive Sections 25.112(a)(3) and 2.106 (Table of Frequency Allocations) of its rules to permit
non-conforming use of the 11.7-11.95 GHz frequency band. Additionally, Intelsat requests a waiver of Section 25.140(b)(2) of the
Commission's rules.

Intelsat North America LLC (Intelsat) has filed an application for the modification of its license for the MARISAT-F2 satellite to
enable it to provide UHF space segment capacity on a non-harmful interference basis at the 33.9 W.L. orbit location. Specifically,
Intelsat seeks authority to operate the MARISAT-F2 satellite in the UHF Narrowband Channel B (311.15 MHz Center Frequency
(uplink) and 257.55 MHz Center Frequency (downlink) on a non-harmful interference basis in order to provide service to a U.S.
Government customer. Intelsat's application notes that any authorization would be conditioned upon the concurrence of the National
Telecommunications and Information Administration in the use of UHF bands.

Further, because the UHF band is not allocated for commercial use in the United States, Intelsat requests a waiver to the extent
necessary of 47 C.F.R. §2.106 (Table of Frequency Allocations). Intelsat also seeks a waiver of those portions of Schedule S for which
it is not technically feasible for Intelsat to provide the required information. In particular, due to the wide UHF beam-width, Intelsat
argues that the required 2 dB antenna beam contour would be well off of the Earth. Intelsat instead provides a contour of 0.8 dB, in
.gxt format, in response to Section S8f.
