                                         Satellite Space Applications Accepted for Filing
The applications listed below have been found, upon initial review, to be acceptable for filing. The Commission reserves
the right to return any of the applications if, upon further examination, it is determined the application is not in
conformance with the Commission's rules or its policies. Consideration of each satellite application in this Public Notice
may depend on the Commission's action on another satellite application earlier in the queue. Petitions, oppositions and
other pleadings filed in response to this notice should conform to Section 25.154 of the Commission's rules, unless
otherwise noted. 47 C.F.R. § 25.154.

Launch and Operating Authority


On September 1, 2006, Sirius Satellite Radio Inc. filed for authority to launch and operate Sirius FM-5, a geostationary satellite, at the
96° W.L. orbital location to provide satellite digital audio radio services (SDARS) to subscribers in the U.S. The FM-5 satellite will
operate service links (space-to-Earth) in the 2320.0-2332.5 MHz frequency band. Feederlinks for the FM-5 satellite will utilize
7025-7075 MHz frequencies in the fixed-satellite service (Earth-to-space). Telemetry, tracking, & control functions will take place in
both the 2320.0-2332.5 MHz and 7025-7075 MHz frequency bands. Sirius requests processing of its application to use the
2320.0-2332.5 MHz and 7025-7075 MHz frequency bands on a streamlined basis similar to that used for replacement satellites,
without a processing round and without the imposition of milestones or bond requirements.
