Modification
Grant of Authority Effective Date: 08/15/2005

Nature of Service: Direct to Home Fixed Satellite, Fixed Satellite Service

On August 15, 2005, the Satellite Division granted with conditions EchoStar Satellite L.L.C..'s application,
SAT-MOD-20050617-00127, to modify its existing authorization (SAT-LOA-20031215-00355 (DA 04-3164) as modified by
SAT-MOD-20041102-00206) to include authority to operate in the 18.3-18.8 GHz (space-to-Earth), 28.35-28.6 GHz
(Earth-to-space), and 29.25-29.5 GHz (Earth-to-space) frequency bands. The conditions contained in its existing authorization
otherwise remain unaffected. Accordingly Echostar Satellite L.L.C. is authorized to launch and operate its Echostar-121W-KuX
satellite in the 10.95-11.2 GHz (space-to-Earth), 11.45-11.7 GHz (space-to-Earth), 18.3-18.8 GHz (space-to-Earth), 13.75-14.0 GHz
(Earth-to-space), 28.35-28.6 GHz (Earth-to-space), and 29.25-29.5 GHz (Earth-to-space) frequency bands at the 121.0°W.L. orbital
location.

SURRENDER
SAT-LOA-19970228-00021 S2241 SkyBridge L.L.C.

On August 17, 2005, SkyBridge L.L.C., surrendered its license to construct, launch, and operate a non-geostationary orbit (NGSO)
fixed satellite service (FSS) system in the Ku-band. See Letter from Gerad Dosogne, President and CEO of SkyBridge, to
Chairman Kevin Martin, Federal Communications Commission (dated August 17, 2005). Under the avoidance of in-line
interference events sharing protocol for the Ku-band NGSO FSS, a number of licensees could potentially share the available
spectrum. Accordingly, the NGSO FSS Ku-band has been, and remains, open to applications that will be processed under the
Commission’s first-come, first-served processes. See Establishment of Policies and Service Rules for the Non-Geostationary
Satellite Orbit, Fixed Satellite Service in the Ku-Band, Report and Order, 17 FCC Rcd 7841, 7844 ¶ 8 (2002); Establishment of
Policies and Service Rules for the Non-Geostationary Satellite Orbit, Fixed Satellite Service in the Ku-Band, Notice of Proposed
Rulemaking, 16 FCC Rcd 9680, 9685 ¶16 (2001).
