Modification 07/20/2005 - 11/30/2013 Grant of Authority Effective Date: 07/20/2005 Nature of Service: Direct to Home Fixed Satellite, Fixed Satellite Service Granted SES Americom, Inc.'s (SES Americom) application, File No. SAT-MOD-20050609-00117, to modify its current authorization, SAT-MOD-20040814-00159. Accordingly, SES Americom's authorization to operate its Ku-band AMC-5 satellite, (Call Sign S2156) currently assigned to the 79.0° W.L. orbital location is modified to reflect operations at 78.95 W.L. with a ±0.05° East-West longitudinal station-keeping, in the frequency bands 11.7-12.2 GHz (space-to-Earth) and 14.0-14.5 GHz (Earth-to-space). Other than the change in the orbital location, the conditions contained in the prior authorization otherwise remain in effect. SAT-MOD-20050609-00118 E S2447 SES Americom, Inc. Modification 12/16/2007 - Grant of Authority Effective Date: 07/20/2005 Nature of Service: Direct to Home Fixed Satellite, Fixed Satellite Service Granted SES Americom, Inc.'s ("SES Americom") application, File No. SAT-MOD-20050609-00118. Accordingly, SES Americom's current authorization (SAT-MOD-20040812-00159) to operate its C-band Satcom C-3 satellite (Call Sign S2447) currently assigned to the 79.0° W.L. orbital location is modified to reflect operations at 79.05 W.L. with ±0.05° East-West longitudinal station-keeping, in the frequency bands 3700-4200 MHz (space-to-Earth) and 5925-6425 MHz (Earth-to-space). Other than the change in orbital location, the conditions contained in the prior authorization otherwise remain in effect. On July 21, 2005, the Policy Branch granted with conditions, pursuant to Sections 303(r), 308, 309, and 310 of the Communications Act of 1934, as amended, 47 U.S.C. §§ 303(r), 308, 309, 310, and Sections 0.261 and 25.137(c) of the Commission's rules, 47 C.F.R. §§ 0.261, 25.137(c), the Petition for Declaratory Ruling filed by Telesat Canada (Telesat) (File No. SAT-PPL-20050504-00094) to add the hybrid C and Ku-band ANIK F1R satellite (Call Sign S2674) located at the 107.3° W.L. orbital location, which is licensed by Canada, to the Commission's Permitted Space Station List. Accordingly, each U.S.-licensed earth station with "ALSAT" designated as a point of communication, IS GRANTED authority to provide Fixed Satellite Services (FSS) in the 3700-4200 MHz (space-to-Earth), 5925-6425 MHz (Earth-to-space), 11.7-12.2 GHz (space-to-Earth) and 14.0-14.5 GHz (Earth-to-space) frequency bands, to, from, or within the United States, by accessing the ANIK F1R satellite (Call Sign S2674) at the 107.3° W.L. orbital location, in accordance with the technical specifications set forth in its petition for declaratory ruling, this Attachment, and the Commission's Rules and subject to the following conditions: a) ANIK F1R is not authorized to provide any Direct-to-Home (DTH) service, Direct Broadcast Satellite (DBS) service, or Digital Audio Radio Service (DARS) to, from, or within the United States; and b) Communications between ALSAT-designated routine earth stations and the ANIK F1R satellite shall be in compliance with the satellite coordination agreements reached between Canada and other administrations. Additionally, waivers of Section 25.210(a)(3) and 25.210(i) of the Commission's rules are GRANTED as conditioned. SAT-PPL-20050513-00099 E S2675 New Skies Satellites B.V. Petition for Declaratory Ruling to be Added to the Permitted List Grant of Authority Effective Date: 07/22/2005 Nature of Service: Fixed Satellite Service On May 13, 2005, New Skies Satellites B.V. filed an application notifying the Commission of a pro forma corporate reorganization and initial public offering of approximately 40 percent of the New Skies companies. Pursuant to this reorganization, four new entities are being inserted into the chain of ownership of New Skies Satellites B.V. (NSSBV), which holds Permitted List Space Stations NSS-5, NSS-7, and NSS-806. These new entities include the transferee in this notification, New Skies Satellites Holdings Ltd., a Bermuda company (NSS Holdings), which will be publicly traded. Accordingly, pursuant to section 25.137(g) of the Commission's rules, the Satellite Division sought comment on whether the transaction affected any of the considerations made when the original satellite operator of stations NSS-5, NSS-7, and NSS-806 was allowed to enter the U.S. market (New Skies Satellites, N.V., DA 01-513, Order, 16 FCC Rcd. 7482 (Int'l Bur., Sat. and Rad. Div., rel. March 29, 2001); New Skies Satellites, N.V., DA 02-1256, Order, 17 FCC Rcd. 10369 (Int'l Bur., Sat. Div., rel. May 28, 2002). See Public Notice, Report No. SAT-00295 (May 27, 2005). No comments were received in response to the Public Notice. After review, the Satellite Division has determined that the transfer of control does not affect any of the considerations made when the original satellite operator was allowed to enter the U.S. market. The Permitted Space Station List will be amended to reflect the change of ownership of NSS-5, NSS-7, and NSS-806 SAT-STA-20050329-00078 E Rainbow DBS Company LLC Special Temporary Authority Grant of Authority Effective Date: 07/21/2005 Nature of Service: Direct Broadcast Satellite Service On July 21, 2005, the Policy Branch granted with conditions Rainbow DBS Company LLC request for extension of authority to operate Rainbow 1 Direct Broadcast Satellite over Channels 23 and 24 at the 61.5° W.L. orbital location under Special Temporary Authority (STA). Operation is authorized for the period of April 2, 2005 to September 29, 2005 subject to the same conditions as its prior STA. INFORMATIVE SAT-LOA-19990427-00047 S2372 Lockheed Martin Corporation On July 20, 2005, Lockheed Martin Corporation filed a $3 million performance bond, payable to the U.S. Treasury, as required by its space station authorization to launch and operate a satellite at 133° W.L. (See Lockheed Martin Corporation, DA 05-1747 (released June 23, 2005.)) The Bureau has determined that Lockheed Martin Corporation has met the Contract Execution, Critical Design Review and Construction Completion milestones associated with this authorization and may reduce the bond amount by 25% for each milestone met as provided in the Amendment of the Commission's Space Station Licensing Rules and Policies, First Report and Order and Further Notice of Proposed Rulemaking, IB Docket No. 02-34, 18 FCC Rcd 10760 (2003); Amendment of the Commission's Space Station Licensing Rules and Policies, First Order on Reconsideration and Fifth Report and Order, IB Docket No. 02-34, 19 FCC Rcd 12637 (2004). Therefore, Lockheed Martin may reduce its required bond amount to $750,000 instead of $3 million.
