                                         Satellite Space Applications Accepted for Filing
The applications listed below have been found, upon initial review, to be acceptable for filing. The Commission reserves
the right to return any of the applications if, upon further examination, it is determined the application is not in
conformance with the Commission's rules or its policies. Consideration of each satellite application in this Public Notice
may depend on the Commission's action on another satellite application earlier in the queue. Petitions, oppositions and
other pleadings filed in response to this notice should conform to Section 25.154 of the Commission's rules, unless
otherwise noted. 47 C.F.R. § 25.154.

ICO Satellite Services, G.P. has filed an application for modification of its authorization to access the United States market using its 2
GHz non-geostationary (NGSO) Mobile Satellite Service satellite system. (See File Nos. SAT-LOI-19970926-00163,
SAT-AMD-20000612-00107 and SAT-AMD-20001103-00155.) ICO seeks to modify the authorization to substitute a single
geostationary satellite for the NGSO system. ICO proposes to operate the GSO satellite at 91º W.L. to provide domestic MSS services
to the United States, including Alaska and Hawaii, Puerto Rico and the U.S. Virgin Islands. ICO will use the portion of the 2000-2020
MHz uplink and 2180-2200 MHz downlink bands available to it under ICO's original LOI authorization for links between the satellite
and the user terminals. ICO requests authority to oeprate feeder links and tracking, telemetry and control (TT&C) functions for its
GSO MSS system within the Ka-band frequency band (29.25-30.00 GHz uplink and 18.55-18.8 and 19.7-20.2 GHz downlink). ICO
seeks authority to conduct limited TT&C operations in the C-band, during transfer orbit and in the event of spacecraft emergencies
and seeks a waiver of the Commission's rules to permit this limited use of C-band frequencies. ICO requests a waiver of the
Commission's rules requiring that GSO satellites be maintained in longitude within +/- 0.05º of its nominal orbital location for all
latitudes within +/- 0.05º of the equator. In addition, ICO requests a waiver of the satellite launch milestone deadline applicable to 2
GHz MSS GSO systems.

Petition for Declaratory Ruling


ICO Satellites Services G.P. has filed a Petition for Declaratory Ruling or, Alternatively, For a Waiver requesting the Commission
approve the milestone certification contained in its Petition. ICO requests the Commission rule that ICO has met the fourth milestone
condition of its letter of intent authorization (see File No. SAT-LOI-19970926-00163) by launching two non-geostationary orbit
satellites in its 2 GHz mobile satellite service system. Alternatively, ICO requests a waiver of the satellite launch milestone if the
Commission determines that the satellite launch milestone requires both the launch and operation of two NGSO satellites.
