                                        Satellite Space Applications Accepted for Filing
The applications listed below have been found, upon initial review, to be acceptable for filing. The Commission reserves
the right to return any of the applications if, upon further examination, it is determined the application is not in
conformance with the Commission's rules or its policies. Consideration of each satellite application in this Public Notice
may depend on the Commission's action on another satellite application earlier in the queue. Petitions, oppositions and
other pleadings filed in response to this notice should conform to Section 25.154 of the Commission's rules, unless
otherwise noted. 47 C.F.R. § 25.154.

On July 14, 2004, the Federal Communications Commission completed the auction of three licenses to use the Direct
Broadcast Satellite ("DBS") service allocation in the 12.2-12.7 GHz band and Associated Feeder Links in the 17.3-17.8 GHz
band ("Auction No. 52"). Auction No. 52 included three licenses at the 175º W.L., 166º W.L., and 157º W.L. orbit
locations. Rainbow DBS won two of the licenses (for 32 channels at 166º W.L. and 32 channels at 175º W.L.), and
EchoStar won one of the licenses (for 29 channels at 157º W.L.). [See Direct Broadcast Satellite Service Licenses Auction

Launch and Operating Authority


Rainbow DBS was the winning bidder for 32 channels at 166º W.L. orbit location. On September 17, 2004, Rainbow DBS filed
long-form applications (FCC Form 312) and Schedule S forms for the licenses won in Auction No. 52. Rainbow DBS requests authority
to construct, launch, and operate a Direct Broadcast Satellite ("DBS") satellite, Rainbow 4, to be located at the 166° W.L. orbit
location. Rainbow plans to provide DBS service to Alaska, Hawaii, and the west coast of the United States through the use of 500 MHz
of Ku-band spectrum already allocated by the Commission to the DBS service operating in the GSO on a Primary or co-Primary basis.
The Rainbow DBS system will use the DBS Ku-band spectrum - 12.2-12.7 GHz for space-to-Earth transmissions and 17.3-17.8 GHz for
Earth-to-space transmissions. The Rainbow DBS plans to use its satellite at the 166° W.L. orbit location to deliver a wide array of
advanced, high-definition digital video services to consumers. Rainbow DBS plans to use on-station telemetry, tracking and control
("TT&C") that will employ guard bands in the 12.2-12.7 GHz (space-to-Earth) and 17.3-17.8 GHz (Earth-to-space) bands in
accordance with Article 2A of Appendices 30 and 30A of the ITU Radio Regulations. In each sense of circular polarization, the
satellite will provide 16 satellite downlink channels for each service area for a total of 32 downlink channels for each of the three
service areas. Each channel will have a bandwidth of 24 MHz.

In addition, to the extent that information relating to specific TT&C frequencies, satellite spacecraft design and other technical
parameters or any other items are unknown to Rainbow DBS because it has not selected a satellite manufacturer, Rainbow DBS requests
a waiver of the rules, to the extent one is necessary, in order to submit its application without the requested information. Rainbow DBS
states that it will supplement and/or amend this application or request a modification to its license when this information becomes
available.

EchoStar Satellite Corporation was the winning bidder for 29 channels at 157º W.L. orbit location. On September 17, 2004, EchoStar
filed long-form applications (FCC Form 312) and Schedule S forms for the licenses won in Auction No. 52. EchoStar requests
authority to construct, launch, and operate a DBS satellite to be located at the 157° W.L. orbit location using the 12.2-12.7 GHz
(space-to-Earth) and 17.3-17.8 GHz (Earth-to-space) frequency bands. EchoStar plans to integrate the new satellite at the 157º W.L.
orbit location with its overall satellite constellation. EchoStar plans to use the additional channel capacity to provide new
programming services such as high-definition television, international programming, and other services. EchoStar states that the
primary use for the satellite is expected to be for MVPD services in the United States. EchoStar states that some of the beam coverage
will extend beyond the U.S. into portions of Canada and Mexico. EchoStar states that subject to any necessary international regulatory
approvals, EchoStar may provide MVPD services to other Region 3 countries. EchoStar states that it plans to provide service to
Alaska and Hawaii including more HDTV offerings and a wider range of niche programming such as international, foreign language,
informational and educations programs.

In addition, to the extent that information relating to specific TT&C frequencies and satellite spacecraft design are unknown to
EchoStar Satellite Corporation because it has not selected a satellite manufacturer, EchoStar Satellite Corporation requests a waiver of
the rules, to the extent one is necessary, in order to submit its application without the requested information. EchoStar Satellite
Corporation states that it will supplement and/or amend this application or request a modification to its license when this information
becomes available.
