Special Temporary Authority


Sirius Satellite Radio, Inc. ("Sirius"), a licensee in the satellite digital audio radio service ("SDARS"), has filed two requests for special
temporary authority ("STA") to operate terrestrial repeaters. By a request filed August 27, 2002, Sirius requests special temporary
authority to operate certain existing terrestrial repeaters with technical specifications different than those notified as part of its STA
granted in November 2001. See File No. SAT-STA-20010724-00064; 16 FCC Rcd 16773 (Int'l Bur. 2001). Sirius claims that these
technical alterations are necessary to implement transmit diversity and to optimize the performance of its SDARS system. By a
request filed August 27, 2003, Sirius seeks to further alter the technical specifications of certain existing terrestrial repeaters, and to
operate 135 additional repeaters throughout the United States. In addition, Sirius has filed letters dated June 16, 2003, September 25,
2003, and October 10, 2003, in which it responds to information requests from Commission staff. These supplemental letters are
included in the above-captioned files. Sirius states that its proposed alterations will not change its obligations to protect licensees in
the Wireless Communications Service ("WCS") and other authorized radiocommunications facilities from interference and are subject
to the outcome of the Further Notice of Proposed Rulemaking in IB Docket No. 95-91. Sirius also represents that it has contacted
representatives of WCS licensees that hold licenses in markets in which Sirius seeks to alter or add repeaters in order to notify them of
the proposed changes.
