On July 10, 2003, PanAmSat filed a Petition to Deny AvL Technologies' application to operate 1.0, 0.96 and 0.75-meter antennas, citing a lack of technical data demonstrating that the 1.0-meter, 0.96-meter and 0.75-meter antennas would be aligned to the accuracy claimed. PanAmSat explicitly stated that the 1.2-meter antenna is not the subject of its Petition to Deny. On October 20, 2003, AvL filed a request to remove the 1.0, 0.96 and 0.75-meter antennas from its application. After reviewing the record minus the 1.0, 0.96 and 0.75-antennas, we grant the application for the one remaining antenna because it meets our criteria for routine processing, and deny the petition to deny, because the subject matter of the petition was withdrawn by the applicant and is no longer an issue requiring resolution.
