Special Temporary Authority


Sirius Satellite Radio Inc. (Sirius), a licensee in the satellite digital audio radio service (SDARS), has filed a request for special temporary
authority (originally dated June 14, 2002) to modify the technical specifications of certain of its terrestrial repeaters and to operate
certain of them with Equivalent Isotropically Radiated Powers (EIRPs) greater than 2 kW. These modifications affect repeaters that
have been previously authorized pursuant to a grant of special temporary authority. (See File No. SAT-STA-20010724-00064). Sirius
recently determined that it must alter the technical specifications of certain of these terrestrial repeaters in order to implement
transmit diversity and to enhance the performance of its SDARS system. Sirius asserts that, in all but two instances, the proposed
changes will reduce the composite transmitter power at a location. Sirius states that its proposed modifications will not alter its
obligations to protect licensees in the Wireless Communications Service (WCS) and other authorized radiocommunications facilities
from interference, and are subject to the outcome of the Further Notice of Proposed Rulemaking in IB Docket No. 95-91. Sirius
represents that it has contacted representatives of WCS licensees that hold licenses in markets in which Sirius seeks to modify repeaters
in order to notify them of the proposed modifications.
