 Modification


 Motorola, Inc. and Teledesic LLC have filed a joint request for an extension of the milestone dates set forth in Motorola's authorization to launch and operate a Ka-band satellite system in the
 fixed-satellite service. Motorola and Teledesic are parties to a transaction in which Motorola has agreed to assign its Millenium GSO FSS license to Teledesic. (See File No.
 SAT-ASG-20010109-00005.) The parties are seeking an extension, or waiver, of the first construction milestone until ninety days after action on the pending application for assignment of
 license.

 Modification


 Teledesic, LLC has filed an application to modify its authorization to launch and operate a non-geostationary fixed-satellite service satellite system. Teledesic proposes to use a constellation
 of 30 operational medium-Earth orbit satellites in five orbit planes, in an altitude of 10,930 km and orbit inclination of 46.7°. Two of the five orbit planes will have six satellites each, including
 an active spare per orbit. The other three planes will have six satellites plus an in-orbit spare in each plane. Continuous commercial service is anticipated with the launch of the first 12
 satellites. The satellites will operate in the 28.6 - 29.1 GHz bands (uplink) and 18.8-19.3 GHz (downlink) frequency bands.

 NOTE: Ex Parte Status of this Proceeding. The application listed above is restricted under the Commission's ex parte rules. See 47 C.F.R. §§ 1.1200, 1.1208. In order to assist the
 Commission in developing a complete record on which a well-reasoned decision can be made, we hereby redesignate this application proceeding as "permit but disclose." We conclude that
 such treatment would best serve the public interest in light of the complex legal and technical issues raised by the application. Accordingly, effective today, ex parte presentations in this
 proceeding are subject to the disclosure requirements set forth in Section 1.1206 of the Commission's rules. 47 C.F.R. § 1.1206.

 This action is taken pursuant to the authority found in Sections 4(i) and 303 of the Communications Act of 1934, as amended, 47 U.S.C. §§ 154(i) and 303; and pursuant to Sections 0.261 and
 1.1200 of the Commission's Rules. See 47 C.F.R. §§ 0.261, and 1.1200.
