The Commission reserves the right to return any of the applications if, upon further examination, it is determined the application is not in conformance with the Commission's rules or its policies. Petitions, oppositions and other pleadings filed in response to this notice should conform to Section 25.154 of the Commission's rules, unless otherwise noted. 47 C.F.R. § 25.154. SAT-LOA-20020104-00001 S2432 SES Americom, Inc. Launch and Operating Authority SES Americom, Inc. has filed an application for authority to launch and operate a new C-band satellite, Americom-10 (AMC-10), to replace its Satcom C-4 satellite at 135° W.L. The Satcom C-4 license expires in October 2002. However, SES Americom estimates that the Satcom C-4 satellite has sufficient fuel to operate until at least November 2004. The anticipated launch date of AMC-10 is July 2004. SES Americom proposes to operate the AMC-10 satellite on a non-common carrier basis with service areas to include the continental United States, Hawaii, Alaska, Puerto Rico, the Virgin Islands, Canada and Mexico. Launch and Operating Authority SES Americom, Inc. has filed an application to launch and operate a new C-band satellite, Americom-11 (AMC-11), to replace its Satcom C-3 satellite at 131° W.L. The Satcom C-3 license expires in December 2002. However, SES Americom estimates that the Satcom C-3 satellite has sufficient fuel to operate until at least May 2005. The estimated launch date of AMC-11 is December 2004. SES Americom proposes to operate the AMC-11 satellite on a non-common carrier basis with service areas to include the continental United States, Hawaii, Alaska, Puerto Rico, the Virgin Islands, Canada and Mexico. SAT-LOA-20020114-00008 S2434 SES Americom, Inc. Launch and Operating Authority SES Americom, Inc. has filed an application to replace its existing Satcom C-2 C-band satellite at 79° W.L. with a new hybrid C/Ku-band satellite, the Americom-9 (AMC-9). If this application is granted, SES Americom will seek authority to move its Americom-5 (AMC-5) satellite, currently providing Ku-band service at 79° W.L., to another orbital location assigned to SES Americom. Satcom C-1 has been operating under Special Temporary Authority since its license expired. However, SES Americom estimates that the Satcom C-1 satellite has sufficient fuel to operate through at least November 2004. The AMC-9 satellite is under construction and SES Americom proposes to launch it by December 2002. File No. SES-LIC-20020109-00023 Call Sign E020010 Digital Broadband Applications Corp. seeks authority to operate an advanced hybrid satellite network to provide high-speed two-way digital data and video services to consumers in the United States. DBAC proposes to use a system architecture that combines U.S.-licensed Ku-band FSS satellite resources for "upstream" communications from consumers and Canadian-licensed DBS satellites located at 91° W.L. and 82° W.L. for "downstream" communications. All services would be distributed within the United States. Ex parte Status of this Application Proceeding: In its application, DBAC requests that to the extent it becomes necessary, the Commission treat consideration of its application as a "permit but disclose" proceeding for purposes of our ex parte rules. In order to assist the Commission in developing a complete record on which a well-reasoned decision can be made, we designate the application as "permit but disclose." We conclude that such treatment would best serve the public interest, in light of the intricate legal and technical issues raised by the application.
