EchoStar Satellite Corporation has a filed letter concerning DBS Public Interest Programming Carriage of UWTV, a non-profit,
non-commercial educational programming service administered by the University of Washington. EchoStar plans to carry UWTV in
fulfillment of the set-aside requirements for non-commercial programming that are applicable to Direct Broadcast Satellite providers.
(47 C.F.R. § 100.5)

Currently, as part of its non-commercial programming line-up, EchoStar carries the ResearchChannel. The ResearchChannel is
provided by a consortium of numerous research institutions and organizations. The University of Washington is one of 20 research
universities that participate in the ResearchChannel consortium and is represented on the ResearchChannel Board of Directors. Under
the Commission's set-aside rules, if multiple channels are under common control, only one can qualify under the set-aside requirements
for non-commercial programming. EchoStar believes the Commission's rules do not preclude simultaneous carriage of the
ResearchChannel and UWTV. In support, EchoStar submits the University of Washington has stated that, while it has representation
on the Board of Directors of the ResearchChannel, the University of Washington does not control the ResearchChannel, which is a
separate entity from the University of Washington and is under independent control.
