The applications listed below have been found, upon initial review, to be acceptable for filing. The Commission reserves
the right to return any of the applications if, upon further examination, it is determined the application is not in
conformance with the Commission's rules or its policies. Consideration of each satellite application in this Public Notice
may depend on the Commission's action on another satellite application earlier in the queue. Petitions, oppositions and
other pleadings filed in response to this notice should conform to Section 25.154 of the Commission's rules, unless

 Letter of Intent


 ViaSat, Inc. requests access to the U.S. market using a proposed Ka-band satellite, VIASAT-KA 89W, which ViaSat plans to operate under the
 authority of the United Kingdom at the 88.9° W.L. orbital location. ViaSat requests U.S. market access to provide Fixed-Satellite Service using
 the following frequency bands: 18.3-19.3 GHz and 19.7-20.2 GHz (space-to-Earth); 28.1-29.1 GHz and 29.5-30.0 GHz (Earth-to-space). ViaSat
 seeks a waiver of Section 2.106, Footnote NG165, of the Commission's rules to permit GSO FSS operations in the 18.8-19.3 GHz band on a
 non-conforming basis. ViaSat states that operations in the 28.6-29.1 GHz and 28.1-28.35 GHz frequency bands would be on a secondary basis.
 ViaSat also seeks waivers of Sections 25.114(c), 25.114(d)(3), 25.114(d)(4), and 25.210(i) of the Commission's rules.

 Special Temporary Authority


 XM Radio LLC requests special temporary authority for a period of 180 days to perform telemetry, tracking, and command operations necessary
 to drift its Satellite Digital Audio Radio Service space station, XM-2, from the 115° W.L. orbital location to the 27° W.L. orbital location in
 preparation for deorbit maneuvers, using the following center frequencies: 2339.2 MHz, 2339.7 MHz, 2344.0 MHz, 2344.5 MHz
 (space-to-Earth); and 7049.0 MHz and 7074.0 MHz (Earth-to-space). XM Radio requests a waiver of Section 25.210(j) of the Commission's
 rules to permit XM-2 to be maintained at 27° W.L. with a +/-0.1 degree east-west stationkeeping tolerance.
