SAT-LOA-20120921-00152 E S2874 EchoStar Satellite Operating Corporation Date Filed: 09/21/2012 20:16:06:39000 Launch and Operating Authority EchoStar Satellite Operating Corporation (EchoStar) requests authority to construct, launch, and operate a satellite, ECHO-45W, that EchoStar intends to use to provide Ku-band Fixed-Satellite Service (FSS) to Brazil from the 45.1° W.L. orbital location. To provide the Ku-band FSS, EchoStar seeks authority to use the 10.7-10.95 GHz (space-to-Earth), 11.2-11.45 GHz (space-to-Earth), and 12.75-13.25 GHz (Earth-to-space) Ku-band frequencies. Additionally, EchoStar plans to use the ECHO-45W satellite to provide Broadcasting Satellite Service to Brazil on additional frequencies licensed by Brazil. EchoStar plans to use the Ku-band FSS frequencies to provide international service that will complement the service provided via the Broadcasting-Satellite Service (BSS) frequencies. The 10.7-10.95 GHz (space-to-Earth), 11.2-11.45 GHz (space-to-Earth), and 12.75-13.25 GHz (Earth-to-space) frequency bands are planned bands under Appendix 30B of the International Telecommunication Union Radio Regulations. EchoStar intends that the United States will seek a modification of the Appendix 30B Plan to include the proposed operations of ECHO-45W as an additional system. No. 2.6bis of Appendix 30B, adopted at the 2007 World Radio Conference, provides that "when submitting additional system(s), administrations "shall limit the number of orbital positions and associated spectrum so that the use of multiple orbital locations to cover the same service area is avoided and the orbital/spectrum natural resources are used rationally, efficiently and economically." Bearing in mind that the United States has two operating networks and service to the United States and Brazil pursuant to Appendix 30B, we ask whether in this case we should consider a U.S.-filed Appendix 30B plan modification as consistent with the goals of Appendix 30B. We also ask what specific criteria the Commission should apply in limiting the use of multiple orbital locations, as encouraged by Appendix 30B, and whether EchoStar's proposed additional system is consistent with reasonable limiting criteria. No. 1.1 of Appendix 30B provides that "The objective of the procedures prescribed in this Appendix is to guarantee in practice, for all countries, equitable access to the geostationary-satellite orbit in the frequency bands of the fixed-satellite service covered by this Appendix." We ask what specific criteria the Commission should apply in limiting the number of additional systems proposed to provide national or multinational services so that this objective is met. We also ask whether the dual licensing arrangement proposed for ECHO-45W is sufficient for EchoStar and the Commission to satisfy their obligations under Section 706 of the Communications Act of 1934, as amended, 47 U.S.C. § 606, concerning the President's emergency powers. SAT-MOD-20130730-00098 E S2369 DIRECTV Enterprises, LLC Date Filed: 07/30/2013 10:53:11:45000 Modification DIRECTV Enterprises, LLC requests that its authorization to operate the DIRECTV 1R space station at the 55.8º E.L. orbital location in the 12.2-12.5 GHz (space-to-Earth) and 17.3-17.6 GHz (Earth-to-space) frequency bands be modified to reflect amendment of DIRECTV's operational agreement with New Skies Satellites, B.V. Condition 4 of the authorization to operate DIRECTV 1R at 55.8º E.L. requires that operations of the spacecraft "must conform to the operational agreement reached between DIRECTV and New Skies, dated December 20, 2012." See also IBFS File Nos. SAT-A/O-20120817-00137, SAT-AMD-2012824-00142, and SAT-AMD-20120913-00148 (granted Dec. 21, 2012). DIRECTV states that it has recently concluded an amendment to that operational agreement. Accordingly, DIRECTV requests that its authorization be modified to provide that operations of DIRECTV 1R at this orbital location "must conform to the operational agreement reached between DIRECTV and New Skies, dated December 20, 2012, as amended from time to time." SAT-MPL-20130906-00114 E S2591 New Skies Satellites B.V. Date Filed: 09/06/2013 21:17:31:00600 Modification to PDR/PPL New Skies Satellites B.V. seeks to modify the terms of the grant of U.S. market access for its NSS-806 space station. Specifically, New Skies requests that its grant of U.S. market access be modified to: (1) reflect the relocation of NSS-806 from the 40.5° W.L. orbital location to the 47.5º W.L. orbital location; (2) allow NSS-806 to provide Fixed-Satellite Service to the United States in the 3600-3700 MHz, 3700-4200 MHz, and 11.7-11.95 GHz frequency bands (space-to-Earth), and in the 5850-5925 MHz, 5925-6425 MHz, 6491-6650 MHz and 14.0-14.25 GHz frequency bands (Earth-to-space); (3) allow NSS-806 to provide direct-to-home services in the 3700-4200 MHz and 11.7-11.95 GHz bands within the United States and between the United States and specified foreign markets; and (4) allow New Skies to re-point the steerable conventional Ku-band spot beam (14.25-14.5 GHz and 11.7-11.95 GHz) on NSS-806 from its current pointing over South America to cover the United States and the Caribbean, and allow future pointing flexibility to re-point the steerable spot beam anywhere within the visible Earth. New Skies seeks continued waivers of Sections 25.202(g), 25.210(a)(1), 25.211(a), 25.114(d)(14)(ii), and 25.283(c) of the Commission's rules, and seeks a waiver of Section 25.210(j) of the Commission's rules to operate NSS-806 with an east-west station keeping of +/- 0.1 degrees.
