1 Telenor Satellite, Inc. ("TSI") filed an amendment to this international Section 214 application on January 12, 2007
to provide information with respect to the proposed transfer of control of TSI to Inceptum. See Letter from Barbara
L. Spencer, General Counsel, to Marlene H. Dortch, Secretary, FCC, Re: Telenor Satellite, Inc., Amendment to
Application for Section 214 Authority, File No. ITC-214-20051005-00395 (Jan. 12, 2007). This amendment has not
yet been assigned a separate file number.

PETITION TO DEFER

The Department of Homeland Security (“DHS”), with the concurrence of the Department of

Justice (“DOJ”) and the Federal Bureau of Investigation (“FBI”), respectfully request that the

Federal Communications Commission (“Commission”) defer action on the above-captioned

applications pending attempted resolution of potential national security, law enforcement, and

public safety issues.

This matter concerns a series of applications (see Public Notice DA 06-2565) filed by Telenor

ASA and Inceptum 1 AS (together the “Applicants”) pursuant to Sections 214 and 310(d) of the

Communications Act of 1934, as amended (the “Act”), and a petition for declaratory ruling

under Section 310(b)(4) of the Act. In the applications filed, the Applicants seek FCC approval

to transfer control of Commission licenses and authorizations held by subsidiaries of Telenor

Satellite Services AS (“TSS”), the indirect parent of Telenor Satellite Inc., Telenor Satellite

Services, Inc., GMPCS Personal Communications, Inc., and Marlink, Inc., to Inceptum.

DHS, DOJ and FBI ("the agencies") are currently reviewing such matter for any national

security, law enforcement, or public safety issue, but have not yet completed that effort. See

generally, In the Matter of Rules and Policies on Foreign Participation in the U.S.

Telecommunications Market, 12 F.C.C. Rcd. 23,891, ¶ 63 (1997). We are therefore requesting

that the Commission defer action until such time as the agencies notify the Commission of the

completion of their review and, based on the results of such review, request appropriate action

by the Commission.

DHS, DOJ and FBI will advise the Commission promptly upon completion of our review.
