On May 30, 2003, an application was filed requesting Commission consent to the voluntary pro forma inter−company transfer of control CERTIFICATION The Applicant waives any claim to the use of any particular frequency or of the electromagnetic spectrum as against the regulatory power of the United States because of the previous use of the same, whether by license or otherwise, and requests an authorization in accordance with this application. Domestic fixed earth station E950404 is used in connection with the operation of television broadcast station WEAR−TV, Pensacola, Florida. On May 30, 2003, an application was filed requesting Commission consent to the voluntary pro forma inter−company transfer of control of WEAR Licensee, LLC from Sinclair Communications, Inc. to Sinclair Communications, LLC. See FCC File No. BTCCT−20030530BNJ. A similar transfer of E950404 will permit continued joint operation of the earth station and television facilities by the same licensee in the provision of television broadcast services. 15
