        APPLICATION FOR RENEWAL OF SPECIAL TEMPORARY AUTHORITY

         By this Application, and pursuant to Section 25.120(b)(3) of the Commission’s rules,1

EchoStar Broadcasting Corporation (“EchoStar Broadcasting” and with its affiliates, “EchoStar”)

respectfully requests renewal of its 60-day Special Temporary Authority (“STA”) to operate four

earth stations (Call Signs E980081, E080215, E080214, and E080015) to perform telemetry,

tracking, and control (“TT&C”) and feeder-link operations with EchoStar 16 at the 61.5º W.L.

orbital location. The current STAs expire on May 20, 2013.2 Each of the referenced earth

stations has an outstanding application to modify its authority to add all EchoStar/DISH DBS

satellites at the 61.5° W.L., 110° W.L., and 119° W.L. orbital clusters as points of

communication.3

I.     BACKGROUND

       EchoStar currently operates four Direct Broadcast Satellites (“DBS”) at the nominal 61.5º

W.L. orbital location: EchoStar 3 (61.8º W.L.), EchoStar 12 (61.35º W.L.), EchoStar 15 (61.65º

W.L.), and EchoStar 16 (61.5º W.L.). Prior to the arrival of EchoStar 16 at 61.5º W.L., EchoStar

15 and EchoStar 12 had been carrying all of the traffic from that orbital location. EchoStar 3 has

been acting as an in-orbit spare.4 EchoStar has completed the transfer of traffic to EchoStar 16

and continues to optimize the use of its satellite fleet in the 61.5º W.L. cluster for DISH services.

II.    GRANT OF THIS APPLICATION IS IN THE PUBLIC INTEREST

       These applications are in the public interest for the reasons set forth in the original STA

grants, which are incorporated herein by reference.5 Furthermore, grant of these applications

will ensure the continued safe operation of EchoStar 16 at the nominal 61.5º W.L. orbital

location while providing important services to consumers.

III.   SECTION 304 WAIVER

       In accordance with Section 304 of the Communications Act of 1934, as amended, 47

U.S.C. § 304, EchoStar Broadcasting hereby waives any claim to the use of any particular

frequency or of the electromagnetic spectrum as against the regulatory power of the United

States because of the previous use of the same, whether by license or otherwise.

IV.    CONCLUSION

       For the foregoing reasons, EchoStar Broadcasting respectfully requests renewal of its 60-

day STA to operate four earth stations (Call Signs E980081, E080215, E080214, and E080015)

to perform TT&C and feeder-link operations with EchoStar 16 at 61.5º W.L.
