NewCom International, Inc. (NewCom) is granted special temporary authority for a period of 30—
days, from October 27, 2012, through November 25, 2012, to communicate with the
Intersputnik Express AM44 space station (AM44) at the 11° W.L. orbital location in the 3705—
3745 MHz and 4005—4045 MHz. (space—to—Earth) and 6030—6070 MHz and 6330—6370 MHz
(Earth—to—space) frequency bands. AM44 operates at 11° W.L. pursuant to a license issued by
the Russian Federation. Operations must be within the emission parameters defined in the
coordination report submitted with this application and are subject to the following conditions:

1. All operations under this grant of special temporary authority shall be on an unprotected and
   non—harmful interference basis, i.e., NewCom shall not cause harmful interference to, and
   shall not claim protection from interference caused to it by, any other lawfully operating
   radiocommunication system.
2. In the event of any harmful interference as a result of the operations under this grant of
   special temporary authority, NewCom shall cease operations immediately upon notification
   of such interference and shall immediately inform the Commission, in writing, of such an
   event.                                                                              '
3. This earth station is not authorized to use Intersputnik Express AM44 to provide any Direct—
   to—Home (DTH) service,
4. Any action taken or expense incurred as a result of operations pursuant to this grant of
   special temporary authority is at NewCom‘s own risk.
5. This action is without prejudice to any enforcement action concerning operations prior to the
   grant date, September 24, 2012, of SES—STA—20120629—00623.
6. Grant of this authorization is without prejudice to any determination that the Commission
   may make regarding any request for regular authority to add AM44 as a point of
   communication.
7. Operations during the period October 24 to 26 were pursuant to Section 1.62 of the
   Commission‘s rules.
8. This action is issued pursuant to Section 0.261 of the Commission‘s rules on delegated

         EXHIBIT A — REQUEST FOR SPECIAL TEMPORARY AUTHORITY


       NewCom International ("NewCom"), pursuant to section 25.120 of the Federal
Communications Commission‘s ("FCC‘s" or "Commission‘s") Rules, 47 C.F.R. § 25.120,
hereby requests an extension of its Special Temporary Authority ("STA") to operate a
transmit/receive C—band satellite earth station in Miami, Florida, communicating with the
Express AM44 ("AM4A4") satellite on a non—common carrier basis. Specifically, NewCom
International, Inc ("NewCom") seeks to continue communicating with the AM44 using an
already authorized Andrew Corp. 7.3 meter antenna ("7.3a") operated under Call Sign EQ40267.
STA extension is sought for a period of 30 days.

       On September 24, 2012, the Commission granted a 30 day STA (SES—STA—20120629—
00623) permitting NewCom to communicate with the AMA44, a Russian licensed satellite
positioned at 11.0 degrees west longitude in the geostationary arc. This STA expires on October
23. NewCom anticipates filing a permanent application in the immediate future to add the
AMA44 as a point of communication for Call Sign E040267, but has not yet received certain
requisite information from third parties necessary to complete the permanent application and/or
complementary technical exhibits.

       With regard to this request for STA extension, NewCom seeks identical authority to that
already granted under SES—STA—20120629—00623. No changes to the earth station‘s technical
parameters are requested, and NewCom will continue to uplink and downlink in the same
frequencies. Specifically, NewCom will operate earth—to—space exclusively on frequencies
within 6030—6070 MHz and 6330—6370 MHz, and operate space—to—earth exclusively on
frequencies within 3705—3745 MHz and 4005—4045 MHz.               ‘

       Grant of this request for STA will serve the public interest by allowing NewCom to
continue providing lifeline communications to underserved parts of the world, including the
provision of telemedicine applications and Internet backbone access to remote customer stations
in Africa and Latin America. As previously explained, in many instances the aforementioned
end users have communicated with the circular polarized C—band Intersputnik satellite that has
historically populated the 11 West Longitude position in the geostationary are for many years.
Given that these end users generally lack the resources to construct new earth station facilities,
and are without access to competitively priced alternative circular polarized C—band satellites, the
AMA44 is the only viable transmission medium for lifeline services. Were NewCom unable to
serve these customers using the AM44, many critical services would be disrupted, including
applications used by humanitarian agencies, hospitals, schools, heavy industry and the financial
community.

     NewCom understands that fixed satellite service downlink operations in the 3650—3700
MHz band are permitted only on a secondary basis, and that terrestrial services licensed under
Part 90 of the Commission‘s rules have priority in the 3650—3700 MHz band. NewCom agrees
to accept interference from the aforementioned higher priority, terrestrial spectrum users.
