Dortch Secretary > — Federal Communications Commission 445 12"" Street, S.W, , Washington, D.C. 20554 M INTELSAT Re: Request for Further Extension of Special Tempdrary Authority Clarksburg, Maryland C—band Earth Station E080011 Dear Ms. Dortch: Intelsat North America LLC ("Intelsat") herein requests a 30—day further extension —— through June 25, 2010 —— of the grant .of Special Temporary Authority (“STA”)1 previously granted Intelsat to utilize its Clarksburg, Maryland C—band earth station (call sign EQ80011) to communicate with the Dutch—licensed NSS—5 satellite at 20° W.L.* The antenna will continue to transmit in the frequency band 5925—6425 MHz and to receive in the frequency band 3700—4200 MHz to/from NSS—5 at 20° W.L. Intelsat‘s license for the . E080011 antenna allows communications in these bands to an Intelsat satellite at this point of communication." Intelsat is using this antenna to support C—band customers previously on Intelsat 603 thathave temporarily been transferred to the NSS—5 satellite upon the latter satellite‘s arrival at 20° W.L. This further extension is necessary to — accommodate two customers. One customer has only very recently asked to remain on NSS—5 for three more weeks before transitioning to another Intelsat satellite —— Intelsat 26. The other customer must remain on NSS—5 because it requires use of Intelast 603 frequencies that have not yet been authorized. Intelsat has received agreement in principle from SES World Skies to allow these customers temporarily to delay their transition off of NSS. Dortch May 25, 2010 Page 2 with therequirements of Section 25.120(a) of the Commission‘s rules* and thus seeks waiver of the requirement to file an STA extension request at least three business days prior to expiration of the existing STA. Because the NSS—5 satellite has not yet been granted U.S. market access, this STA further extension request seeks authority for the EQO80011 earth station to continue to communicate temporarily with a Dutch—licensed satellite. Intelsat incorporates herein by reference the market access showing made by New Skies Satellites B.V. in its market access petition." Grant of this STA further extension request will not result in risk of harmful interference into any lawfully operating facility. The antenna will continue to communicate with the NSS—5 satellite in accordance with the technical parameters of its current license. In the extremely unlikely event that harmful interference should occur, Intelsat will take all reasonable steps to eliminate the interference. 6 Grant of this STA further extension request will ensure continuity of service to these two Intelsat C—band customers that wish temporarily to delay their ~ transition back to an Intelsat satellite.
