Special Temporary Authority to allow Vizada to utilize 13.75 to 14.0 frequencies and emissions for
the SBY30O/VER 9 meter antenna at Southbury to communicate with the Telstar 11N       (TILIN)    satellite at
37.5 W.L.         Clarification that the 13.75 to 14.0 authority is not for ESV operations.     13.75 to 14.0
GHz operation is only needed and only being requested for operation of the SBY30O/VER 9 meter
antenna to communicate with TI1N.

 13.75 — 14.0 GHz Frequencies and Emissions for the SBY3O/VER 9 Meter Antenna to
                    Communicate With the Telstar 1 1N Satellite

       Vizada, Inc. ("Vizada") requests a grant of Special Temporary Authority ("STA")
effective October 8, 2009 to allow Vizada to utilize 13.75 — 14.0 GHz frequencies and
emissions for the SBY30/VER 9 meter fixed antenna at Southbury, Connecticut to
communicate with the Telstar 11N (TIIN) satellite at 37.5 W.L.

        Grant of this STA is needed for Vizada to ensure continuity of service to its
existing customers. The STA will allow Vizada to utilize the new TIIN satellite to
provide Ku—band Earth Stations on Vessels (ESV) service to customers in the TI1IN
footprint, thus enhancing the Ku—band ESV service that Vizada currently provides to
existing customers through expansion of the service area. In addition, grant of this STA
will allow Vizada to offer new Ku—band ESV service to vessels operating in areas which
are not currently covered by a Ku—band footprint.

        The 13.75 — 14.0 GHz portion ofVizada‘s previous application for STA in this
matter was dismissed on October 2, 2009 by the Commission without prejudice to
refilling (File No. SES—STA—20090831—01101). The basis for the dismissal was that the
purpose for the new frequencies (and emissions) is to allow Vizada to utilize the new
TIIN satellite to provide Ku—band ESV service to customers in the TIIN footprint but
that the 13.75 — 14.0 GHz band is not allocated for ESV operations.

        Vizada clarifies that the transmissions from the ESVs to the satellite will not be
on 13.75 — 14.0 GHz frequencies. The ESVs to receive service via TIIN will operate
only in the 10.950 to 11.200, 11.450 to 11.700, 11.700 to 12.200 and 14.000 to 14.500
GHz bands as permitted by Section 25.222 of the Commission‘s rules and existing WB36
ESV authority. Authority is not being requested to utilize the 13.75 — 14.0 GHz
frequencies for ESV operations. The authority for the 13.75 — 14.0 GHz frequencies and
emissions is only needed and only being requested for operation of the SBY3O/VER 9
meter fixed antenna to communicate with TIIN.

       Vizada has an application pending before the Commission (SES—MOD—20090720—
00882, filed July 20, 2009 as amended October 6, 2009 ) to modify the WB36 license of
the Southbury, Connecticut, fixed transmit/receive earth station to add 13.75 — 14.0 GHz
band frequencies and emissions to the authorization for the SBY30/VER 9 meter fixed


antenna at Southbury. The purpose for the 13.75 — 14.0 GHz band frequencies and
emissions is to allow Vizada to utilize the new TIIN satellite to provide Ku—band ESV
service to customers in the TIIN footprint pursuant to WB36 license authority as
previously granted by the Commission.

        Grant of this STA is in the public interest because it will enable Vizada to provide
continuity of service to current customers while transitioning to a satellite that will allow
for provision of enhanced service over a larger service area; provide improved safety for
ships at sea by offering higher quality communications services at lower costs via a more
modern satellite over a larger area of the Atlantic; and provide the opportunity for ESV
operators to utilize Ku—band instead of C—band in a larger service area. This directly
promotes the Commission‘s policy to encourage ESV operators to use the Ku—band rather
than the C—band, See Procedures to Govern the Use of Satellite Earth Stations on Board
 Vessels in the 5925—6425 MHz/3700—4200 MHz Bands and 14.0—14.5 GHz/11.7—12.2 GHz
. Bands, IB Docket No. 02—10, Report and Order, FCC 04—286, 20 FCC Red 674 (2005) at
  705, 1 75; Procedures to Govern the Use of Satellite Earth Stations on Board Vessels in
the 5925—6425 MHz/3700—4200 MHz Bands and 14.0—14.5 GHz/11.7—12.2 GHz Bands, IB
Docket No. 02—10, FCC 09—63, Order on Reconsideration at 3, ([ 2 (rel. July 31, 2009).
Allowing Vizada to access the AOR beam of T—1 1N will enable Vizada to provide Ku—
band service to customers transiting the Atlantic between North Africa and South
America. Customers that heretofore have required a C—band service will therefore be
able to utilize a Ku—band service instead.

       As previously noted, the ESVs will operate only on frequencies permitted by
Section 25.222 of the Commission‘s rules and existing WB36 ESV authority. The
authority for the 13.75 — 14.0 GHz frequencies and emissions is only needed and only
being requested for operation of the SBY30/VER 9 meter fixed antenna to communicate
with TIIN.

        Accordingly, Vizada respectfully requests that the International Bureau grant the
 STA to be effective October 8, 2009 for a period of sixty (60) days. The communications
with T1IIN as well as the Ku—band ESV service will be in full compliance with the
Commission‘s Rules as well as all provisions of the WB36 license. Vizada understands
and accepts that authority to operate the hub antenna on 13.75 — 14.0 GHz band
frequencies will be conditioned on agreement to cease transmissions if required. The
