        Re:     Request for Special Temporary Authority

    Pursuant to Section 25.120(a) of the Rules and Regulations ("Regulations") of the Federal
Communications Commission ("Commission"), Data Technology Solutions, LLC. ("DTS") seeks
Commission consideration for a Special Temporary Authority ("STA") to operate an Earth
Stations on Vessels ("ESV") system while its application for permanent authority is under review
by the Commission.

    On August 7, 2009, DTS filed an application for new ESV authority (File No. SES—LIC—
20090807—00971, callsign E090138). The proposed application would authorize DTS to operate
ESVs on cargo ships, fishing vessels, and oil & gas marine craft. Crew members on these vessels
are often at sea for prolonged periods and have limited communications with the outside world.
The proposed authorization would permit crew personnel to access the internet, telephone, and
email while at sea thus providing a much needed lifeline that would contribute to the crew
member‘s health, well—being, and safety.

         According to Section 25.120(b)(3) of the Regulations, the Commission may grant
temporary authority for a period not to exceed 60 days, if the STA request has not been placed on
public notice, and the applicant plans to file a request for regular authority for the service. In the
instant case, the STA request has not been placed on public notice, but DTS has already filed an
application for regular authority. Therefore, DTS respectfully requests an STA for a period not to
exceed 60 days.

        According to Section 25.120 (b)(1) of the Commission‘s rules, "The Commission may
grant a temporary authorization only upon a finding that there are extraordinary circumstances
requiring temporary operations in the public interest and that delay in the institution of these
temporary operations would seriously prejudice the public interest". For the reasons stated above,
DTS believes that the provision of lifeline communications is an extraordinary circumstance and
the granting of the STA is in the public interest.

   In order to insure timely service, the requested date for prior use is August 19, 2009. In
accordance to Section 25.120(a) of the Regulations, this STA is being filed at least 3 working days
prior to the date of proposed operation.
