SES Americom Inc. File No. SES—STA—20090520—00630 The request of SES Americom Inc. (SES Americom) for special temporary authority (STA) IS GRANTED for a period of 60 days, commencing May 22, 2009, subject to the technical specifications set forth in its application, the Commission‘s rules, and the following conditions: 1. All operations shall be on a non—harmful interference basis, i.e., SES Americom shall not cause interference to, and shall not claim protection from interference caused to it by, any other lawfully operating satellites. 2. In the event of any harmful interference as a result of SES Americom‘s operations, SES Americom shall cease operations immediately upon notification of such interference and shall inform the Commission, in writing, immediately of such an event. 3. SES Americom shall inform its customers that its operations with the NSS—9 space station using the extended C—band frequencies are on a non—harmful interference basis and that SES Americom must cease operations upon notification of such interference. 4. Grant of this authorization is without prejudice to any determination that the Commission may make regarding SES Americom‘s pending petition for declaratory ruling to use the NSS—9 space station to provide Fixed Satellite Services (FSS) in the extended C—band frequencies (IBFS File No. SAT—LOI—20081223—00238). 5. SES Americom is afforded thirty days from the date of release of this grant and authorization to decline this authorization as conditioned. Failure to respond within this period will constitute formal acceptance of the authorization as conditioned. 6. This action is taken pursuant to Section 0.261 of the Commission‘s rules on delegated authority, 47 C.FER. § 0.261, and is effective immediately. Petitions for reconsideration under Section 1.106 or applications for review under Section 1.115 of the Commission‘s rules, 47 C.ER. §§ 1.106, 1.115, may be filed within 30 days of the date of the publicnotice indicating that this action was taken.
