The request of SES Americom Inc. (SES Americom) for special temporary authority (STA) IS
GRANTED for a period of 60 days, commencing March 23, 2009, subject to the technical
specifications set forth in its application, the Commission‘s rules, and the following conditions:

        1.   All operations shall be on a non—harmful interference basis, i.e., SES Americom shall
not cause interference to, and shall not claim protection from interference caused to it by, any
other lawfully operating satellites.

      2. In the event of any harmful interference as a result of SES Americom‘s operations,
SES Americom shall cease operations immediately upon notification of such interference and
shall inform the Commission, in writing, immediately of such an event.

       3.    SES Americom shall inform its customers that its operations with the NSS—9 space
station using the extended C—band frequencies are on a non—harmful interference basis and that
SES Americom must cease operations upon notification of such interference.

      4. Grant of this authorization is without prejudice to any determination that the
Commission may make regarding SES Americom‘s pending petition for declaratory ruling to use
the NSS—9 space station to provide Fixed Satellite Services (FSS) in the extended C—band
frequencies (IBFS File No. SAT—LOI—20081223—00238).

       5. SES Americom is afforded thirty days from the date of release of this grant and
authorization to decline this authorization as conditioned. Failure to respond within this period
will constitute formal acceptance of the authorization as conditioned.

       6. This action is taken pursuant to Section 0.261 of the Commission‘s rules on delegated
authority, 47 C.F.R. § 0.261, and is effective immediately. Petitions for reconsideration under
Section 1.106 or applications for review under Section 1.115 of the Commission‘s rules, 47
C.ER. §§ 1.106, 1.115, may be filed within 30 days of the date of the public notice indicating
that this action was taken.

                   REQUEST FOR SPECIAL TEMPORARY AUTHORITY


SES Americom, Inc. ("SES Americom") hereby requests the expedited grant of a 60—day Special
Temporary Authority ("STA") to operate the KA294 earth station in Brewster, Washington, to
transmit only to the Netherlands—licensed NSS—9 satellite at 177° W.L. using the extended C—
band uplink frequencies (5850—5925 MHz). SES Americom respectfully requests that such
authority be granted by March 23, 2009, in order to ensure continuity of service to a U.S.
government user transitioning from NSS—5 to NSS—9. The proposed operations will be on a non—
harmful interference, non—protected basis, pending the grant of regular operating authority. SES
Americom will file an application for permanent authority as soon as coordination has been
completed.

The Commission has granted U.S. market access for NSS—9 in the conventional C— and Ku—
bands,‘ and a request for authority to provide service in the extended C—band remains pending
before the Commission." As the Commission is aware, the NSS—9 sateilite was launched on
February 12, 2009, to replace the existing NSS—5 satellite operating at 177° W.L.

In this application, SES Americom is requesting an STA to allow the KA294 earth station to
operate in the extended C—band uplink frequencies, pending the grant of an application seeking
regular operating authority for communications with NSS—9 in this band. An existing
government user, the U.S. Department of Defense, is currently using capacity on NSS—5 to
transmit the Armed Forces Radio and Television Service ("AFRTS") programming to an earth
stationin Hong Kong (and then to other destinations), and will continue to do so when NSS—5 is
replaced by NSS—9. However, on NSS—9, the Defense Department will be transmitting AFRTS
on the extended C—band uplink frequencies rather than the conventional C—band. In order to
ensure a smooth transition with sufficient time to resolve any unforeseen issues with its
operations on the new satellite, SES Americom respectfully requests that an STA be granted by
March 23, 2009. Grant of an STA by that date will minimize disruption to this and other
customers and ensure best quality of service for the Department of Defense during the transition.

SES Americom‘s proposed operations under this STA will be on a non—harmful interference
basis. The risk of harmful interference in this instance is particularly low. While the KA294
earth station has been coordinated to transmit on the 5850—5925 MHz frequencies to certain
orbital locations over the Pacific Ocean Region, it has not been specifically coordinated to
transmit to a satellite located at 177° W.L. However, SES Americom is authorized to operate
another earth station (E960222) just a few hundred feet away that has been coordinated to use the
5850—5925 MHz frequencies to communicate with satellites in the 619—191° W.L. orbital arc.
The nearby E960222 earth station cannot be used in this instance because it is located on the
eastern side of a building that blocks its view of 177° W.L.

The proposed STA operations will be consistent with the U.S. Table of Allocations forthe 5850—
5925 MHz band. The proposed operations will be for an uplink—only service out of the United

States that will downlink in Hong Kong. The service therefore meets the "international inter—
continental systems" requirement in footnote US$245.3 SES Americom is also aware of
electromagnetic compatibility concerns arising from the co—primary Federal Government
radiolocation allocation in the 5850—5925 MHz band," and is prepared to accept the potential for
interference caused to its communications links from such radiolocation systems, including high—
powered land—based transportable and shipborne radar transmitters operating in this band in
accordance with footnote G2.

Grant of this STA will serve the public interest by ensuring continuity of service for the Defense
Department‘s AFRTS, a service that benefits the U.S. Armed Forces stationed around the world.
Furthermore, there is a very low probability of interference into government services that may be
operating in this band because an SES Americom earth station located nearby has been
coordinated to use the same frequencies for service to 177° W.L.

For all of these reasons, SES Americom respectfully requests the expeditious grant of the STA
by March 23, 2009.
