     REQUESTS FOR EXTENSION OF SPECIAL TEMPORARY AUTHORITY
                           January 2009

          New ICO Satellite Services G.P. ("ICO") hereby requests a 60—day extension —
. through March 27, 2009 — of the Special Temporary Authority ("STA") originally
  granted to ICO‘s North Las Vegas, Nevada S—band earth station (Call Sign EO80035) to
  conduct in—orbit testing ("IOT") (SES—STA—20081223—01699). In addition, ICO seeks to
  consolidate this authority and extension with that of a separate STA granted to ICO for
  the same North Las Vegas facility (SES—STA—20081223—01697).‘ The requested actions
  involve only previously authorized operations, and would ensure that both North Las
  Vegas STAs run and expire concurrently. ICO will be filing an application to seek a
  modification to the permanent S—band authorization for the North Las Vegas facility, in
  order to include the frequencies being tested. Grant of the requested extensions will
  allow ICO to continue its analysis of the performance of advanced software with the
  highly precise spacecraft elements that are the key components of the GBBF system.
  ICO requests authority to continue these tests for a period of 60 days from January 26
  through March 27, 2009.

         ICO is currently conducting a series of tests to ascertain the functionality of its
 two—way ground based beam forming ("GBBF") system by simulating forward traffic
 loading using CONUS and spot beams. ICO recognizes that operations under these STAs
 that are at variance with the underlying licenses for this earth station will be performed
 on a non—harmful interference basis, and is prepared to terminate all such operations
 immediately upon notification from the Commission that harmful interference is being
 caused thereby to any authorized user of the frequency band. Potentially affected
 microwave licensees have been notified of the revised testing dates, and provided with
 contact information for ICO personnel who will be available in the event that any
 significant impact to a licensed system is detected during the test period.

          ICO requests that the Bureau extend the STAs to test as described above using the
  S—band antenna for a period of 60 days ending March 27, 2009. ICO would adhere to
  conditions previously imposed on ICO‘s special temporary authority, as shown below.
  Grant of the requested extensions will allow ICO to verify performance of its innovative
  GBBF technology in a detailed way. The requested extensions will thus ensure the
  effective and timely provision of service to customers in the United States, and is in the
  public interest.

  Condition

  All operations shall be on an unprotected and non—harmful interference basis, i.e., New
  ICO Satellite Services G.P. shall not cause harmful interference to, and shall not claim
  protection from, any other lawfully operating station. In the event of any harmful

interference as a result of New ICO Satellite Services G.P.‘s operations immediately
upon notification of such interference, and shall inform the Federal Communications
Commission (FCC), in writing, immediately of such event.
