Attachment Conditions of Special Temporary Authority SES—STA—20081110—01464 SES Americom, Inc. Call Sign: E080162 SES Americom, Inc.‘s (SES Americom) request for Special Temporary Authority, File No. SES— STA—20081110—01464 is GRANTED. Accordingly, SES Americomis authorized to permit Earth Station E080162 in Vernon, New Jersey to use the 17.3—17.8 GHz and 12.2—12.7 GHz band frequencies to communicate with the Ciel 2 spacecraft, a Canadian licensed Direct Broadcast Satellite, at the 129° W.L. orbital location to provide telemetry, tracking, and control. This authorization is for a period of 60 days commencing December 10, 2008, and is subject to the terms, conditions, and technical specifications set forth in the application, this Attachment, and the Federal Communication Commission‘s Rules: 1. SES Americom‘s earth station operations shall be on a non—harmful interference basis, /.e. SES Americom shall not cause harmful interference to, and shall not claim protection from interference caused to it by any other lawfully operating earth station orsatellites. 2. In the event that any harmful interference occurs as a result of the earth station, SES Americom shall cease operations immediately upon notification ofsuch interference and shall inform the Commission in writing within 24 hours ofsuch an event, 3. SES Americomis prohibited from sending or receiving any Direct—to—Home service, Direct Broadcast Satellite Service, or Digital Audio Radio Service to or from the satellite. 4. SES Americom is prohibited from sending or receiving analog video services from any FM video television services to or from the satellite. 5. SES Americom‘s operations of this earth station must be consistent with the services proposedin File No. SES—MFS—20080926—01242. This authorizationis without prejudice to the Commission‘s action in File No. SES—MFS—20080926—01242. 6. As set forth in Article 18 ofthe ITU Radio Regulations, the United States is not the "government ofthe country to which" the satellite "is subject," and is not acting on behalf of any other government. Operations of the earth station are expressly conditioned upon the Ciel 2 space station having been licensed, within the meaning of Article 18, by the government, or on behaif of the government, ofthe countryto which the satellite is subject. 7. This authorization is issued pursuant to 47 C.F.R. § 0.261, the Commission‘s rules on delegated authority, and is effective upon release.
