Conditions:

Footnote NG104 to 47 C.EF.R. §2.106. ofthe Commission‘s rules IS WAIVED to allow MSV to
transmit test signals in the 12.75—13.25 GHz and 10940.50 — 10945.50 MHz frequency bands
between an earth station in Napa, California and the MSAT—1 and MSAT—2 satellites, subject to
the following conditions:

MSV shall cease such operation immediately upon receiving notification that it is causing
harmful interference.

MSV‘s use of the 12.75—13.25 GHz frequency band shall comply with the terms of Footnote
US251 to 47 C.F.R. § 2.106 to ensure that MSV—I‘s Ku—band transmissions will not interfere with
space research (deep space) (space—to—Earth) service at Goldstone, California.

Operation in the 12.75—13.25 GHz band shall comply with any applicable additional requirements
adopted in the rulemaking proceeding in ET Docket No. 03—254.

MSV shall take all practicable steps to protect radio astronomy observations from harmful
interference fromits use of the 10940.50 — 10945.50 MHz frequency band pursuant to this
authorization.
