K Mart Corporation FCC Form 312 — STA Narrative Exhibit January 2008 REQUEST FOR SPECIAL TEMPORARY AUTHORITY K Mart Corporation ("K Mart") hereby requests Special Temporary Authority (STA) beginning on February 14, 2008, and continuing for 60 days thereafter (to April 14, 2008) to operate up to 1,000 1.2 meter Andrew Model 123 remote terminals through K Mart‘s hub antenna (Call Sign E861095). The antennas in question are currently authorized to be operated pursuant to an STA held by HNS License Sub, LLC ("Hughes") under Call Sign E000166 (see File No. SES—STA—20080107—00017). The operation of the terminals under Hughes‘s license was a temporary arrangement made for terminals operated as part of the VSAT network of the Sears retail chain following the acquisition of Sears by the K Mart Corporation. It had been K Mart‘s intention to modify the license for Call Sign E861095 to include the subject terminals. The application for authority to modify K Mart‘s license for Call Sign E861095 to include 1,000 1.2 meter Andrew Model 123 remote antennas was filed on January 23, 2008. The 1,000 antennas that are the subject of this authorization are the terminals that will need to be operated pending action on the modification of license application for the VSAT network. The antennas are identical to the ones now operated by Hughes under the referenced STA for Call Sign E0O0O0166. The technical information for these terminals is identical to the information submitted in the Modification of License application for Call Sign E861095 in File No. SES—MOD—20080123—00087. K Mart hereby incorporates by reference the technical information provided in Schedule B and the exhibits to this application. K Mart does not request ALSAT authority for the Andrew Model 123 antennas that will be operated through the K Mart VSAT network. The terminals requested under this STA will be operated exclusively with the Intelsat Galaxy 10R satellite at 123° W.L. Andrew Corporation has informed K Mart that its Model 123 antenna may not be fully compliant with Section 25.209(a) of the Commission‘s Rules. Out of an abundance of caution, K Mart has coordinated its temporary operation of the subject Andrew 1.2 meter terminals with the operators of all Ku—band satellites within six degrees of 123° W.L. It has received assent to the operation of the subject terminals from EchoStar Corporation and Telesat Canada, which operate the only two potentially affected spacecraft other than those operated by Intelsat. The coordination agreements are included as Attachment 1 to Exhibit A of the January 2008 Modification Application now pending for Call Sign £E861095. The requested Special Temporary Authority will serve the public interest by ensuring that K Mart outlets customer will continue to have access to the VSAT network services that are vital to the operation of its retail business during the consolidation phase 252842: vI

of its parent company‘s communications facilities following the merger of Sears and K Mart. K Mart is submitting this request pursuant to Section 25.120(b)(3) of the Commission‘s rules, 47 C.F.R. § 25.120(b)(3), and is doing so more than three business days in advance of the requested commencement date. For all of the foregoing reasons, K Mart respectfully requests that the Commission grant this request for Special Temporary Authority to include 1,000 of the described 1.2 meter diameter Andrew antennas as part of its network for operation with the Galaxy 10R satellite at 123° W.L. for a period of 60 days, commencing February 14, 2008, pending Commission action on the underlying modification application for Call Sign E861095 in File No. SES—MOD—20080123—00087. 252842; vl
