HNS License Sub, LLC FCC Form 312 — STA Narrative Exhibit October 2007 REQUEST FOR EXTENSION OF SPECIAL TEMPORARY AUTHORITY Call Sign: E000166 HNS License Sub, LLC ("Hughes") hereby requests that the Commission extend for 30 days the Special Temporary Authority, File No. SES—STA—20070829—01149 ("August STA"), it granted Hughes that allows Hughes to operate up to 1,000 1.2 meter Andrew Model 123 remote terminals through Hughes‘ Germantown hub. The July STA became effective on September 11, 2007, and expires on October 10, 2007. The instant request would continue that authority for an additional 30 days, through November 9, 2007. In its request for the original STA in July (File No. SES—STA—20070724—00980), Hughes described how the antennas in question are currently authorized to be operated pursuant to a license held by Spacenet Services License Sub, Inc. under Call Sign E990294, and are included as part of the VSAT network of the Sears retail chain. The antennas had been refitted to operate through Hughes VSAT network as an interim step to the ultimate inclusion of the terminals on the authorization for K Mart Corp.‘s VSAT network under Call Sign E861095. The K Mart Corp. application for modification of its license remains in preparation, so an extension of the STA for an additional 30 days is required. All terms and operating conditions of the July STA are unchanged, and the information in the request for the original STA request is hereby incorporated by reference into this extension request. The requested extension of the August STA will serve the public interest by ensuring that Hughes‘s customer will continue to have access to the VSAT network services that are vital to the operation of its retail business during the consolidation phase of its parent company‘s communications facilities following the merger of Sears and K Mart. Again, Hughes expects that permanent authority by K Mart Corporation to operate the same terminals as part of K Mart‘s own VSAT system (operation will continue on Galaxy 10R) will be sought in the very near future. For all of the foregoing reasons, Hughes respectfully requests that the Commission extend for an additional period of 30 days —1.e., through November 9, 2007 — the STA in File No. SES—STA—20070829—01149 authorizing Hughes to include 1,000 1.2 meter diameter Andrew antennas as part of its network for operation with the Galaxy 10R satellite at 123° W.L. 250791: v2
