Accordingly, Loralis authorized to operate an earth station in Kapolci, Hawaii (Call Sign: E980250), using conventional C—band frequebcies, 6427—6463 MHz Transmit (V,H), 41224158 MHz Receive (V,H1), to communigate with the Telstar 18/ Apstar V/ Tongasat. satellite at (Interational designation:2004—024A) the.138° EL. orbital location for the period of August 4, 2006 to October 12, 2006 in accordance with the terms, conditions, and technical specifications set forth in its application, this Attachment and the Federal Communications Commissioh‘s (‘Commission®) Rules. 1. Lorals earth station peration shall be on a non—harmful interference basis,i. Loral shall not cause harmful interference to, and shall not claim protection from interference caused t@ht by, any other lawfully operating earth station or satelltes. 2.. In the event that any armful interference occurs as a result of the earth station, Loral shall cease ope ations immediately upon notification of such intererence and shall inform the ommission in writing immediately of such an event. 3. Loral is prohibited in sending or receiving any Directto—Home (DTH) service, Direct Broadcast Sat ite (DBS) service, or Digital Audio Radio Service (DARS) to or from the satellit 4. Loral is prohibited im sending or receiving analog video services or any FM video television servide s to or from the satelite. 5.. With reference to Article 18 of the ITU Radio Regulations, the United States is not the "government bf the country to which" the satellte "is subject," and is not acting. on behalf of ay other government. 6. Loral is only authofized to provide communication services from the Loral Kapolci, Hawail station that would communicate to points in WTO member countries within the gitelite footprint. 7.
