       Mobile Satellite VenturesBubsidiary LLC ("MSV") hereby files this Response to the

Joint Reply of SkyWave Mobile @ommunications, Inc. ("SkyWave"), Stratos Communications,
Inc.(‘Stratos"), Satammaties, Inc, (Satamatics"), Telenor Satellte Inc.("Telenor‘), and Inmarsat
Ventures Limited ("Inmarsat®)         SV‘s Comments on the above—captioned request for a third

60—day renewal of existing grantgiof Special Temporary Authority ("STA") to operate carlier—
generation mobile earth terminalglusing the uncoordinated Inmarsat 4F2 satellte at 52.75° W.L.

As MSV explained in its Commeits, the Bureau should continue to apply the conditions imposed
on the original STA grants for earfier—generation services as well as () immediately require
Inmarsatto cease its use of the lodhed frequencies and (i) establish a firm expization date for

these STAs without Inmarsat havifrg completed coordination of the Inmarsat 4F2 satellte with

the United States.

        In the Joint Reply,           and its distributors claim that use ofthe Inmarsat 4F2
satellte for earlie—generationt serices has not adversely affected the interference environment.

relinguish the loaned frequenties Bespite the harm that is being caused to MSV and its

customers. MSY Comments it 2—3, This harm is occurring today by precluding MSV from using
these frequencies to support @xistifg customers and for testing and deploying new, bandwidth—
intensive services on its present system and for its next—generation integrated satellite—terrestrial
network. As MSV noted in its Céfnments, public safety users have been particularly harmed by
Inmarsat‘s refusal to retur the logned frequencies. /. at 2. Inmarsat and its distributors are

MSV‘s next—generation system. Jbint Reply at 3. In fact, public safety users have expressed
concem to the Commission that Imarsat‘s refusal toretur the loaned frequencies will impede

the critical services MSV offers tdday to public safety users. The Commonwealth of Kentucky‘s

Division of Emergency Manageme nt, an MSV user, has informed the Commission that there is a
significant risk that Inmarsat‘s un    ordinated operations will "interfere with our existing critical
public safety operations"" and that ie loaned frequencies are "required for MSV to develop new
and innovative service for public pfety users, including additional services that further improve
interoperable communications.""
       Moreover, as MSV recent         explained in Comments filed on the Commission‘s Notice of
Proposed Rulemaking (°NPRMF‘) ecking input on the recommendations ofthe Independent
Pane! Reviewing the Impact of Hi pricane Katrina on Communications Networks ("Katrina
Pane1")," MSV currently offets th     only satellit—based push—to—talk (‘PTT") service in the
country today." This product allojr s point—to—point or point—to—multipoint voice communications
among users in a customer—definet group using a PTT handsct. Using a customer—defined
calling group, a public safety use    an communicate with one or up to 10,000 users

simultancousy. With this technolbgy,all users within the call group receive the same

MSV‘s PTT service can be of critle al    importance in keeping first responders informed. In
addition, MSV‘s PTT service can       c interfaced with existing terrestrial—based public safety
radios (‘LMRs®) or commercial B       hanced Specialized Mobile Radios ("ESMR®), and thus serve

as satellite repeater to both techologies. This enables the radios to continue to function even

when the terrestrial infrastructure upporting the LMRs or ESMERs is destroyed. Ttis precisely
this type ofcritical, interoperable ublic safety service that is being impeded by Inmarsat‘s
continued refusal to return loaned requencies and continued operation ofuncoordinated
satelltes.


        In its Comments, MSV          ested that the Bureau provide a clear expiration date forthese
                              EI coordination of its new and relocated Inmarsat satelltes,

offering broadband services, which Chairman Martin recently explained is the Commission‘s top

priority.® 1f, however, the Bureaul    ntinues to grant and renew STAs for use of Inmarsat‘s
