Dear Ms. Swank:
On January 26, 2006, Universal Space Network, Inc. (USN)filed the above—captioned application
secking special temporary authority to operate an S—Band‘ earth station to supportthe SPAINSAT
spacecraftduring launch & early orbit (LEOP). The anticipated launch dateis February 21, 2006.
Pursuant to Section 25.1 12(a)(1) ofthe Commission‘s rules, 47 C.F.R.§25.1 12(a)(1), we dismiss
this application
USN seeks to operate on 2239.276 MHz witha 200KOGZD emission. The U.S. Table of
FrequencyAllocations, Section 2.106 ofthe Commission‘s rules,"however, docs notinclude an
allocation for non—Federal Goverment use ofthis band. USN also requests to operate on 2062.0
MHtz with a 200KOG2D emission. The U.S. Table ofFrequency Allocations, however, does not
include an allocation for non—Federal Govermment Space Operations in this band. We dismiss
USN‘s STA requestfor failre o include a waiverrequest of the Table of Frequency Allocations
to permit non—conforming uses
In the event that USN refilesits STA request to operate in the 2025—21 10 and 2200—2200 MHtz
bands, it should include an adequately supported requestfor waiver oall applicable Commission
rules. In this case, such a request should include, among other things, an explanation as to any
unique or compellingcircumstances warranting of accessing a frequency band allocated
exclusively to Federal Govermment Space Operation use. In addition, any grant ofsuch a waiver
request would be premised on completion ofcoordination with other parties operating

communication systems in compliance withthe Table ofFrequency Allocations, 47 CER. §
2.106. Accortingly, pursuant to Section 25.112(@(1) of the Commission‘s ules, 47 C.FR.
§25.112(a)(1), and Section 0.261 ofthe Commission‘s rules on delegations ofauthority, 47
CIFR. §0.261, we dismis this application without prejudice to refiing.
