Dear Ms. Swank
On January 26, 2006, Universal Space Network, Inc. (USN)filed the above—captioned application
secking specialtemporary authority to operate an $—Band‘ earth station to supportthe Hotbird—7A
spacecraft during launch & early orbit (LEOP) for approximately 10 days. The anticipated
launch date is February 21, 2006. Pursuantto Section 25.1 12(a(1) ofhe Commission‘s rules, 47
CFR. §25.112(a)(1), we dismiss this application.
USN seeks to operate on 2265.2 MHz with a 200KOG2D emission. The U.S. Table of Frequency
Allocations,Section 2.106 ofthe Commission‘s rules," however,does not include anallocation
for non—Federal Government use ofthis band. USN also requeststo operate on 2085.9 MHz with
a 200KOG2D emission. The U.S. Table of Frequency Allocations, however, does not include an
allocation for non—Federal Govermment Space Operations in this band. We dismiss USN‘s STA
request for faluret include a waiver request of the Table of Frequency Allocations to permit
non—conforming uses.
In the event that USN refilesis STA requestto operate in the 2025—21 10 and 2200—2290 MHz
bands, it should include an adequately supported request for waiver of all applicable Commission
rules. In this case, such a request should include, among other things, an explanation as to any
unique or compelling circumstances warranting ofaccessing a frequency band allocated
exclusively o Federal Govermment Space Operation use. In addition, any grant ofsuch a waiver
request would be premised on completion ofcoordination with other parties operating

communication systems in complianee with the Table ofFrequency Allocations, 47 CER. §
2.106. Accordingly, pursuant to Section 25.1 12(a)(1) ofthe Commission‘s rules, 47 C.FR.
§25.112@)(1), and Section 0.261 ofthe Commission‘s ules on delegations ofauthority, 47
CER. §0.261, we dismissthis application without prejudice torefling.
