                     REQUEST FOR SPECIAL TEMPORARY AUTHORITY

        Carol Sue Rutherford (“Rutherford”), pursuant to Section 25.120 of the Commission’s
rules, hereby requests Special Temporary Authority (“STA”) to operate a routine Ku-band 3.5
meter transmit/receive earth station located in Lexington, Kentucky for 30 days pending grant of
a soon to be filed earth station modification application.

        Rutherford seeks to add a 3.5 meter Ku-band antenna to its earth station with call sign
E010291. The 3.5 meter earth station will operate at the same geographic longitude/latitude
location as the earth station with license E010291.1 Rutherford requests authority to operate its
3.5 meter Ku-band earth station beginning immediately and continuing for a period of 30 days,
or until the grant of its soon-to-be-filed modification application, whichever occurs first.

       Grant of the requested STA will serve the public interest by ensuring Rutherford’s
continuous provision of service to its customers. Grant of this STA is also unlikely to cause any
harmful interference because Rutherford will operate the earth station consistent with the
technical parameters prescribed in the Commission’s rules for Ku-band earth stations. In the
unlikely event that harmful interference occurs, Rutherford will take all necessary steps to
eliminate the interference. Accordingly, and for good cause shown, Rutherford respectfully
requests STA to operate a 3.5 meter Ku-band earth station in Lexington, Kentucky.

  The FCC licenses fixed-earth stations according to the nearest one second of latitude and one second of longitude.
As a result, multiple antennas may be included on a single fixed-earth station license if they are within one second of
latitude and one second of longitude.
